Bill Summary
This bill creates an exception to the following offenses for certain registered students of a public institution of higher education:
(1) The Class E felony offense of possessing or carrying, whether openly or concealed, with the intent to go armed, any firearm, explosive, explosive weapon, bowie knife, hawk bill knife, ice pick, dagger, slingshot, leaded cane, switchblade knife, blackjack, knuckles or any other weapon of like kind, not used solely for instructional or school-sanctioned ceremonial purposes, in any public or private school building or bus, on any public or private school campus, grounds, recreation area, athletic field or any other property owned, operated, or while in use by any board of education, school, college or university board of trustees, regents or directors for the administration of any public or private educational institution; and
(2) The Class B misdemeanor offense of a person possessing or carrying, whether openly or concealed, any firearm, not used solely for instructional or school-sanctioned ceremonial purposes, in any public or private school building or bus, on any public or private school campus, grounds, recreation area, athletic field or any other property owned, operated, or while in use by any board of education, school, college or university board of trustees, regents or directors for the administration of any public or private educational institution.
Present law contains several exceptions to the above offenses. This bill adds to those exceptions that the above offenses will not apply to registered students of a public institution of higher education who are:
(1) Authorized to carry a handgun pursuant to present permit laws;
(2) On property owned, operated, or controlled by the public institution of higher education at which the student is registered;
(3) Carrying the handgun in a concealed manner; and
(4) Otherwise in compliance with state law.
