This bill provides that a member of the Tennessee national guard or a member of the national guard cannot be released from state duty into federal active duty combat unless the United States Congress passes an official declaration of war or official action pursuant to the United States Constitution, Article 1, Section 8, Clause 15, explicitly calling forth the Tennessee national guard or members of the national guard for the enumerated purposes to expressly execute the laws of the union, repel an invasion, or suppress an insurrection. However, this bill does not limit or prohibit the governor from consenting to the deployment of a Tennessee national guard member under federal law for defense support for civil authority missions within the United States and United States territories.
