Illinois, Kansas City, and Everytown Sue ATF for Granting Firearms License to Manufacturer Tied to Firearms Law Violations

Everytown for Gun Safety Support Fund, et al. v. Bureau of Alcohol, Tobacco, Firearms and Explosives, et al.

1.19.2021

The State of Illinois, the City of Kansas City, Missouri, and Everytown for Gun Safety Support Fund have filed a lawsuit to vacate the issuance of a firearms license to the successor company, J.A. Industries, to the now-bankrupt gun manufacturer Jimenez Arms. The lawsuit cites evidence that Jimenez Arms repeatedly violated federal firearms laws, made misleading statements in obtaining a firearms license, and contributed to gun trafficking and criminal activity in Illinois and Kansas City. The lawsuit, filed on January 15, 2021, alleges that, by issuing a firearms license Jimenez Arms’ successor and failing to conduct an adequate investigation before issuing that license, the Bureau of Alcohol, Tobacco, Firearms and Explosives violated critical protections in federal firearms laws that prevent the agency from issuing licenses to applicants who have violated firearms laws or made misleading statements in connection with firearms licensing applications. On August 13, 2021, Illinois, Kansas City, and Everytown moved for summary judgment.

On March 30, 2022, the ATF notified the Court that it had issued a notice of revocation to J.A. Industries.
