    Bill Summary

    Under present law, whenever three-light traffic-control signals are used displaying successively green, yellow, and red lights for the direction of motorists and pedestrians, the minimum time exposure of the yellow light must be three seconds. A state agency or political subdivision that installs, owns, operates, or maintains such a traffic-control signal light must set or cause to be set the timing-control device for the signal light in compliance with this minimum time exposure requirement. A state agency or political subdivision that installs, owns, operates, or maintains a traffic-control signal light in an intersection that employs a surveillance camera for the enforcement or monitoring of traffic violations is prohibited from reducing the time exposure of the yellow light at the intersection with the intended purpose of increasing the number of traffic violations.

    This bill deletes the provisions above and provides, instead, that the department of transportation must promulgate rules that establish standardized lengths of time a traffic-control signal to display the yellow or "Caution" signal light, when following the green or "Go" signal light. The lengths of time for the display signals must be standardized by speed limit. This bill requires that a state agency or political subdivision that installs, owns, operates, or maintains a traffic-control signal light must ensure that each traffic-control signal complies with the standardized display times and must not reduce the time exposure of the yellow signal light, including at an intersection that employs a surveillance camera for the enforcement or monitoring of traffic violations with the intended purpose of increasing the number of traffic violations.

    ON APRIL 17, 2023, THE HOUSE ADOPTED AMENDMENT #1 AND PASSED HOUSE BILL 766, AS AMENDED.

    AMENDMENT #1 rewrites this bill to provide the following:

    (1) That, whenever in this state three-light traffic-control signals are used displaying successively green, yellow, and red lights for the direction of motorists and pedestrians, the duration of the yellow plus all red change interval must be determined using engineering practices as identified in the Manual on Uniform Traffic Control Devices (MUTCD), as adopted by the department of transportation, and the minimum time exposure of the yellow light must be three seconds;

    (2) That a state agency or political subdivision that installs, owns, operates, or maintains any such traffic-control signal light must set or cause to be set the timing-control device for the signal light in compliance with this bill and the MUTCD, as adopted by the department of transportation; and

    (3) That a state agency or political subdivision that installs, owns, operates, or maintains a traffic-control signal light in an intersection that employs a surveillance camera for the enforcement or monitoring of traffic violations must not reduce the time exposure of the yellow light at the intersection with the intended purpose of increasing the number of traffic violations.
