Comptroller, State - As enacted, requires the comptroller of the treasury to compare a list of registered voters provided by the state coordinator of elections to the comptroller’s geographic information system data to ensure that registered voters have been assigned to the correct congressional, state house, state senate, and county governing body districts. - Amends TCA Section 2-3-102.

    Bill Summary

    Present law generally prohibits a voting precinct from being established, created, consolidated, divided, or the boundaries otherwise altered unless ordered by a court of competent jurisdiction, by reason of an annexation or other change in the boundary of a county or municipality. A precinct boundary that is altered must coincide with a census block as designated by the United States census bureau in the latest federal decennial census.

    However, the county election commission may establish, consolidate, or change the boundaries of precincts whenever the public convenience or law requires it, subject to the following conditions:

    (1) A precinct boundary that is so altered must coincide with a census block as designated by the United States census bureau in the latest federal decennial census; and

    (2) All precinct boundaries within the jurisdiction of the county election commission that do not coincide with a census block as designated by the United States census bureau in the latest federal decennial census must be altered so that the precinct boundaries do coincide with a census block as designated by the United States census bureau in the latest federal decennial census.

    A county election commission that alters the boundaries of a voting precinct must send a map, or geographic information systems file, to the comptroller that clearly delineates the new boundaries of the voting precinct.

    This bill provides that, after each decennial reapportionment, the state coordinator of elections must submit a list of registered voters that has been submitted by each county to the comptroller. The comptroller is required to compare the lists of registered voters received from the state coordinator of elections to the comptroller's geographic information system data to ensure that voters have been assigned to the correct congressional, state house, state senate, and county governing body districts.

    This bill requires that, after the comptroller completes this comparison, the comptroller must provide the results of the comparison, including a list of potential misassignments, to the county administrator of elections of each county and the state coordinator of elections. Each county administrator of elections is required to review the results of the comparison and make the final determination regarding the correct assignment of the registered voter.

    This bill requires that within seven days of making its final determination regarding the correct assignment of potentially misassigned voters, each county administrator of elections must notify the comptroller and the state coordinator of elections of their determinations, including a justification for any instance in which the final determination of the county administrator deviates from the comptroller's assignment of the registered voter.
