Situation in the Philippines: ICC Pre-Trial Chamber I authorises the opening of an investigation

​Today, on 15 September 2021, the Pre-Trial Chamber I of the International Criminal Court ("ICC" or "Court") granted the Prosecutor's request to commence an investigation in relation to crimes within the jurisdiction of the Court allegedly committed on the territory of the Philippines between 1 November 2011 and 16 March 2019 in the context of the so-called 'war on drugs' campaign.

On 14 June 2021, the Prosecutor filed a public redacted version of the request to open an investigation, initially submitted on 24 May 2021, requesting authorisation to commence an investigation into the Situation in the Philippines, as provided for in Article 15(3) of the Rome Statute.

Pre-Trial Chamber I composed of Judge Péter Kovács, Presiding Judge, Judge Reine Adélaïde Sophie Alapini-Gansou and Judge María del Socorro Flores Liera, examined the Prosecutor's request and supporting material. The Chamber also considered 204 victims' representations received pursuant to Article 15(3) of the Statute.

In accordance with Article 15(4) of the Statute, the Chamber found that there is a reasonable basis to proceed with an investigation, noting that specific legal element of the crime against humanity of murder under Article 7(1)(a) of the Statute has been met with respect to the killings committed throughout the Philippines between 1 July 2016 and 16 March 2019 in the context of the so-called 'war on drugs' campaign, as well as with respect to the killings in the Davao area between 1 November 2011 and 30 June 2016. The Chamber emphasised that, based on the facts as they emerge at the present stage and subject to proper investigation and further analysis, the so-called 'war on drugs' campaign cannot be seen as a legitimate law enforcement operation, and the killings neither as legitimate nor as mere excesses in an otherwise legitimate operation. Rather, the available material indicates, to the required standard, that a widespread and systematic attack against the civilian population took place pursuant to or in furtherance of a State policy, within the meaning of Article 7(1) and (2)(a) of the Statute.

Philippines, State party to the Rome Statute since 1 November 2011, deposited a written notification of withdrawal from the Statute on 17 March 2018. While the Philippines' withdrawal from the Statute took effect on 17 March 2019, the Court retains jurisdiction with respect to alleged crimes that occurred on the territory of the Philippines while it was a State Party, from 1 November 2011 up to and including 16 March 2019. While the relevant crimes appear to have continued after this date, the Chamber noted that alleged crimes identified in the Article 15(3) Request are limited to those during the period when the Philippines was a State Party to the Statute and was bound by its provisions.

Ngayon, ng 15 ng Setyembre 2021, ang Tanggapan ng Internasyonal na Korte Para sa Krimen bago simulan ang aktuwal na paglilitis I ("ICC" o "Korte") ay nagbigay ng kapangyarihan sa kahilingan ng Piskal para magsimula ng imbestigasyon na may kaugnayan sa mga krimen na napasailalim ng hurisdiksiyon ng Korte na umano'y ginawa sa teritoryo ng Pilipinas sa pagitan ng 1 Nobyembre 2011 at 16 Marso 2019 sa konteksto ng tinatawag na 'Giyera laban sa mga druga' na kampanya.

Noong 14 Hunyo 2021, ang Piskal ay naghain ng inihandang isinulat na pampublikong ulat ng kahilingan para magsimula ng imbestigasyon, unang isinusumite noong 24 Mayo 2021, humihiling ng kapangyarihan para magsimula ng imbestigasyon tungkol sa Kalagayan ng Pilipinas, na itinakda para sa Artikulo 15(3) ng Kautusan ng Roma.

Ang Tanggapan bago simulan ang aktuwal na paglilitis I ay binubuo nina Huwes Péter Kovács, Pamunuang-Huwes, Huwes Reine Adélaïde Sophie Alapini-Gansou at Huwes María del Socorro Flores Liera, ay sumusuri sa kahilingan ng Piskal at ng mga sumusuportang materyal. Itinuturing din ng Tanggapan ang mga reperesentasyon ng 204 na mga biktima na natanggap sang-ayon sa Artikulo 15(3) ng Kautusan.

Bilang  pag-alinsunod ng Artkulo 15 (4) ng Kautusan, nagtatag ang Tanggapan na mayroong resonabling basihan para mag-umpisa ng imbestigasyon, itinatala na ang mga partikular na legal na elemento ng krimen laban sa pagpatay ng sangkatauhan na napasailalim ng Artikulo 7(1)(a) ng Kautusan ay naitutupad na may kaugnayan sa patayan na nagawa sa lahat ng dako ng Pilipinas sa pagitan ng 1 Hulyo 2016 at 16 Marso 2019 sa konteksto ng tinatawag na 'giyera laban sa mga druga' na kampanya, gayundin na may kaugnayan sa mga patayan sa lugar ng Davao sa pagitan ng 1 Nobyembre 2011 at 30 Hunyo 2016.  Binigyan-diin ng Tanggapan na, batay sa mga pangyayari na lumalabas sa kasulukuyang panahon at batay sa wastong imbestigasyon at pagpatuloy na pagsusuri, ang tinatawag na 'giyera laban sa mga druga' na kampanya ay hindi maisaalang-alang bilang isang alinsunod sa batas na pagpapatupad na pamamahala (operasyon), at ang mga patayan alinman sa legal o isa lamang kalabisan nang naiibang legal na pamamahala (operasyon).  Higit pa, ang mga magagamit na mga materyales ay nagpapakita, para sa hinihiling na pamantayan, na ang pagpapalaganap ng sistematikong pag-aatake laban sa mga sibilyang populasyon ay nangyayari alinsunod sa o ay isang pagsulong ng polisiya ng Estado, sa loob ng kahulugan ng Artikulo 7(1) at (2)(a) ng Kautusan.

Ang Pilipinas, ay isang Estadong Partido ng Kautusan ng Roma simula noong 1 Nobyembre 2011, naglalapag ng naisulat na pagbibigay-alam ng pag-alis mula sa Kautusan noong 17 Marso 2018. Samantalang ang pag-alis ng Pilipinas mula sa Kautusan ay nagkaroon ng bisa (epekto) noong 17 Marso 2019, nananatili ang hurisdiksiyon ng Korte tungkol sa umano'y mga krimen na nangyayari sa teritoryo ng Pilipinas samantalang iyan ay isang Estadong Partido, galing ng 1 Nobyembre 2011  hanggang at kasali ang 16 Marso 2019. Samantalang ang nauukol na mga krimen ay lumalabas na patuloy na nangyayari hanggang pagkatapos ng petsang ito.Itinatala ng Tanggapan na ang mga umano'y  krimen ay naitutukoy sa Artikulo 15(3). Ang kahilingan ay limitado para sa panahon na kung kailan ang Pilipinas ay isang Estadong Partido ng Kauutusan at nasasakop sa mga kasunduan.
