New hope for a real end to OCP? 

Operation Choke Point (OCP) is an initiative kicked off in March 2013 by the Department of Justice (DoJ) Consumer Protection Working Group to stop banks and payment processors from providing financial services to merchants that were suspected of consumer fraud.  Although independent ATM deployers (IADs) were not specifically indicated as targets of OCP, as cash-based payment businesses IADs have had their cash and settlement accounts closed simply because those accounts allegedly meet some of the warning signs FIs have been instructed to look for – specifically, significant fluctuation in the amount of funds flowing thru the account from month to month.
Title III of the Dodd-Frank Act was supposed to have codified fair access to financial services and fair treatment of customers.  And to its credit, the OCC has twice issued guidance to specifically address reports of banks refusing to provide financial services to entire industry categories engaged in lawful business activities.
In order to clarify and better enforce fair access requirements, the OCC is proposing the addition of 12 CFR Part 55.  It states in part that covered banks shall "Not deny any person a financial service the bank offers except to the extent justified by such person’s quantified and documented failure to meet quantitative, impartial risk-based standards established in advance by the covered bank."
Public comment on this proposal can be submitted through January 4, 2021.  ATMIA USA will offer its enthusiastic support for the new rule.  And also suggest that it be expanded to include a requirement for written documentation of the basis of denials or account terminations.

Legislative alert sponsorship available

ATMIA USA has renewed the Stateside Associates monitoring services for 2021.  This is a terrific benefit for all ATMIA members.   It includes legislative alerts, regulatory (new law) alerts, and the ATM compliance portal.

The number varies a bit, but somewhere between 400 and 500 ATMIA members receive every alert throughout the year.  In a typical year, 250-300 alerts are sent out  which totals somewhere between 100,000 and 150,000 impressions!
Linked logos of both sponsors are displayed in the header of the email alert, along with a printed link at the bottom of the message.  Sponsors also receive multiple mentions for their support in the this newsletter, during meetings, and in news items generated by Stateside activity.

Coronavirus updates

Good progress is being made on the ATMIA Advocacy Plan for COVID-19 and Beyond.  Part of that plan is the ATMIA Cash Revival Plan
The new ATM Hygiene & Safety Committee has been very active and recently published its “ATM Hygiene Protocol & Best Practices” document.  A UV-C sub-committee was formed to look at technology for ATM and cash sanitizing.  In addition, an ATM Hygiene Showroom page has been set up for hygiene related products.
The Coronavirus webpage continues to serve as a repository for ATMIA press releases and statements relating to managing this crisis and advocating for cash as a consumer payment choice.  It also includes news feeds specifically relating to the pandemic and a mid-week report on state-by-state activity.. 

2021 Washington, DC Fly-in delayed, pending a sponsor

Our 2021 DC Fly-in had been scheduled for Wednesday, March 24, 2021 on Capitol Hill, with a strategy meeting to take place March 23rd at 5:00pm ET.  Due to the continuing uncertainty surrounding in-person meetings, the Fly-in is being postponed.  Once we have confidence in our ability to have face-to-face meetings, a new date will be scheduled.  
In order to host the Fly-In this year, we will need a Sponsor for the event! This is a great opportunity to host a very visible and important advocacy event – and give your organization some unique exposure for the next 6 or 7 months.  And promotion of the event will continue until it takes place.
It is too early to determine what our focus will be, but support for reintroduction of the Payment Choice Act bills in the Senate and House, as well as the new OCC rulemaking, are expected to be at the top of our list.

ATMIA Publishes New “Next Gen ATM User Interface and Metrics” Best Practices

To mark the milestone of launching the certification system for Next Gen ATMs, which enable customers to transact at ATMs via their mobile bank apps, ATMIA today published its “Next Gen ATM User Interface and Metrics” best practices. The aim of the new industry manual is guide ATM operators, vendors and service-providers to measure how to maximize the customer experience and interface at Next Gen ATMs.

Why you should be involved in at least one committee group

Access to ATMIA committee groups is one of the most beneficial perks of membership.  And you have your pick of regional groups, global groups - or both.  There are no limits on how many groups you may participate in.  The only restriction is that you can only join regional committees that are part of a region of which you are a member.
Two of the most popular U.S. regional groups are for ATM deployers – one for financial institutions and one for independents.  Our largest global groups are the Consortium for NextGen ATMs and a variety of different security related committees.
Obviously each group is a great vehicle for keeping up with happenings related to its area of expertise.  It is also a conduit for expressing your own views on critical  policies and developments.  And there is no better way to get to know your colleagues.

Independent ATM Deployers (IAD) Committee

All IADs and their providers are welcome to participate in the IAD Committee, which meets bimonthly.  The next  meeting is scheduled for Wednesday, February 10 at 11:00am EST.  Meeting invitations have been sent to all committee members, with agendas to follow shortly.

U.S.Government Relations Committee (GRC)

The GRC meets regularly to discuss regulatory and compliance issues affecting the industry, from federal, state, and local governments.  It meets next on Thursday, February 18, 2021 at 11:00am EST.  Meeting invitations will be been sent to all committee members, with agendas to follow prior to the meeting.
