Notable Actions

Energy Conservation Standards
The Department of Energy (DOE) published four rules related to the Energy Conservation Standards. In these rules, DOE determined that the standards for consumer furnace fans and oil, electric, and weatherized gas consumer furnaces do not need to be amended. Both are effective November 18. 
DOE confirmed the effective and compliance dates (July 15, 2024 and March 1, 2028, respectively) of the amended standards for residential clothes washers that were established in a March direct final rule. DOE also published the Department of Justice’s determination that the standards for consumer conventional cooking products, established in a February direct final rule, are unlikely to have a significant adverse impact on competition. 
Abatement of Highway Traffic and Construction Noise
The Department of Transportation is proposing to revise the regulations on the procedures for abatement of highway traffic noise and construction noise. The proposed rule would clarify certain definitions, the applicability of this rulemaking, certain analysis requirements, and the eligibility of funds made available to provide noise abatement measures and to improve the analytical procedures. Comments due December 17.
Advanced Manufacturing Investment Credit
The Internal Revenue Service issued a final rule to implement the advanced manufacturing investment credit established by the CHIPS Act of 2022 to incentivize the manufacture of semiconductors and semiconductor manufacturing equipment within the U.S. The rule contains the eligibility requirements for the credit, and a special 10-year credit recapture rule that applies if there is a significant transaction involving the material expansion of semiconductor manufacturing capacity in a foreign country of concern. Effective December 23.
