Welcome 2021!!  

I am sure that there are many of us who had wonderful things happen in their lives this past year.  For most of us, though, we are happy to see 2020 in our rear view mirror and the promises of the year to come before us.  Including, hopefully, an end to the pandemic.
Along with an end to the pandemic, there is pent-up enthusiasm for getting back to in-person events and group meetings.  Although the dates for our 2021 U.S. conference have been pushed back to April, interest in participation has significantly picked up since the turn of the new year.  And we will host the actual, first, in-person U.S. Security Conference in September.
On the advocacy front, there is a lot of very promising activity to report.  Last month, the OCC proposed the addition of 12 CFR Part 55.  It states in part that covered banks shall "Not deny any person a financial service the bank offers except to the extent justified by such person’s quantified and documented failure to meet quantitative, impartial risk-based standards established in advance by the covered bank."
After 35,000 stakeholder comments, the OCC announced finalization of the rule last week.  This is expected to be an end to the majority of issues our independent operators have experienced with spurious and politically motivated bank account closures.
Despite the beating that cash has taken in the media during this pandemic, ATMIA has continued to advocate for its safety and importance to our economy.  In fact the consensus within the banking and ATM community is that, although transaction volumes are still a bit lower than one year ago, the value of cash withdrawals in increasing – in some cases even to record levels.
The effort to ban cashless retail establishments is also seeing an early surge.  In the final days of 2020, both Pennsylvania and Maryland pre-filed measures to require that retail businesses accept cash as a form of payment.  Mississippi has already indicated its intent to introduce a cashless ban bill this year. Rep. Ben Koppelman, a North Dakota state legislator, recently states that cashless transactions create economic barriers for some residents and that he supports a cashless ban.  For the latest status of cashless bans in every state, visit the Cashless Ban'd Wagon interactive map on the ATMIA U.S. Region home page

Counting down to the 2021 U.S. Conference

Only 98 days remain until the start of the ATM industry's largest and most important conference – the ATMIA U.S. Conference & Expo.
Day 1 begins the event with pre-conference workshops and committee meetings for ATMIA members.  Sign up for a workshop to take a deep-dive into essential and timely topics – including ATM outsourcing (from both the FI and IAD perspective), recycling and cash management, the future of biometrics in the ATM channel, and launching your fleet into the era of NextGen ATMs.  Later in the day, ATMIA members are invited to attend the ATM Town Hall – a panel discussion of cutting-edge and forward-looking technology impacting the ATM industry, followed by the Opening Reception.
Day 2 kicks off the conference’s formal educational program.  Take your pick of 18 breakout sessions covering a full spectrum of educational topics.  Our new format was launched this year in Houston, using a restructured lineup of breakout tracks – Financial Institutions, IAD/ISO, and ATM Industry.
Day 3 features an impressive roster of plenary sessions.  Presenters address topics that affect all sectors of the ATM industry.  Sessions already committed include a review by the Federal Reserve of key findings from a 2020 study.  It will examine comparisons to 2019 pre-COVID data in order to better understand how the COVID pandemic has affected consumer’s use of cash.

Get ready to start re-hiring!

Advocacy

State advocacy issues

Legislative activity in the states last  year was down more than a third from that of other recent years - likely due to the pandemic - and certainly not a bad thing.  2021, however, may be a particularly busy year as states try to catch up on legislative ambitions.  It is a bit early, though, to know for sure what the next 12 months will look like.

New York AB 941

Aside from two bills on consumer payment choice that were pre-filed at the end of last year, New York AB 941 is the first bill introduced of consequence to the ATM industry.  The bill's intent is to "ensure that consumers are informed of their options in regard to overdraft  protection prior to incurring fees by establishing appropriate protections for such consumers."
The bill requires that the fee must be "separately and conspicuously disclosed, each time the fee is imposed, in any periodic statement provided to the consumer with respect to such account."  ATMIA has reached out to the bill's sponsor as to how this requirement would be applied to ATM transactions, keeping in mind the technology challenges and privacy risks it imposes.
We have commented further that independently operated ATMs typically do not have the capability to handle overdraft notification, even if the networks developed the technology and were able to provide it.
ATM operators with any terminals in the state of New York are asked to contact their state Assemblymember and oppose this bill.

Legislative alert sponsorship available

ATMIA USA has renewed the Stateside Associates monitoring services for 2021.  This is a terrific benefit for all ATMIA members.   It includes legislative alerts, regulatory (new law) alerts, and the ATM compliance portal.
It is set up as a dual sponsorship – and Cardtronics has already committed to continuing as one of those sponsors.  A second sponsorship is also available.
The number varies a bit, but somewhere between 400 and 500 ATMIA members receive every alert throughout the year.  In a typical year, 250-300 alerts are sent out  which totals somewhere between 100,000 and 150,000 impressions!
Linked logos of both sponsors are displayed in the header of the email alert, along with a printed link at the bottom of the message.  Sponsors also receive multiple mentions for their support in the this newsletter, during meetings, and in news items generated by Stateside activity.

Coronavirus updates

Good progress is being made on the ATMIA Advocacy Plan for COVID-19 and Beyond.  Part of that plan is the ATMIA Cash Revival Plan
The new ATM Hygiene & Safety Committee has been very active and recently published its “ATM Hygiene Protocol & Best Practices” document.  A UV-C sub-committee was formed to look at technology for ATM and cash sanitizing.  In addition, an ATM Hygiene Showroom page has been set up for hygiene related products.
The Coronavirus webpage continues to serve as a repository for ATMIA press releases and statements relating to managing this crisis and advocating for cash as a consumer payment choice.  It also includes news feeds specifically relating to the pandemic and a mid-week report on state-by-state activity.. 

2021 Washington, DC Fly-in delayed, pending a sponsor

Our 2021 DC Fly-in had been scheduled for Wednesday, March 24, 2021 on Capitol Hill, with a strategy meeting to take place March 23rd at 5:00pm ET.  Due to the continuing uncertainty surrounding in-person meetings, the Fly-in has been postponed.  Once we have confidence in our ability to have face-to-face meetings, a new date will be scheduled.  
In order to host the Fly-In this year, we will need a Sponsor for the event! This is a great opportunity to host a very visible and important advocacy event – and give your organization some unique exposure for the next 6 or 7 months.  And promotion of the event will continue until it takes place.
It is too early to determine what our focus will be, but support for reintroduction of the Payment Choice Act bills in the Senate and House, as well as the new OCC rulemaking, are expected to be at the top of our list.

Why you should be involved in at least one committee group

Access to ATMIA committee groups is one of the most beneficial perks of membership.  And you have your pick of regional groups, global groups - or both.  There are no limits on how many groups you may participate in.  The only restriction is that you can only join regional committees that are part of a region of which you are a member.
Two of the most popular U.S. regional groups are for ATM deployers – one for financial institutions and one for independents.  Our largest global groups are the Consortium for NextGen ATMs and a variety of different security related committees.
Obviously each group is a great vehicle for keeping up with happenings related to its area of expertise.  It is also a conduit for expressing your own views on critical  policies and developments.  And there is no better way to get to know your colleagues.

Independent ATM Deployers (IAD) Committee

All IADs and their providers are welcome to participate in the IAD Committee, which meets bimonthly.  The next  meeting is scheduled for Wednesday, February 10 at 11:00am EST.  Meeting invitations have been sent to all committee members, with agendas to follow shortly.

U.S. Regional Board

The U.S. Regional Board meets quarterly to discuss important issues, committee activities, and the financial health of the chapter. The next  meeting is scheduled for Thursday, February 11 at 11:00am EST and is open to all U.S. board-level members. 

U.S.Government Relations Committee (GRC)

The GRC meets regularly to discuss regulatory and compliance issues affecting the industry, from federal, state, and local governments.  It meets next on Thursday, February 18, 2021 at 11:00am EST.  Meeting invitations will be been sent to all committee members, with agendas to follow prior to the meeting.
