The fact that RBAC chose to fight the claim, and yet they lost, is one more indication among many that society is rightly becoming less tolerant, both of sexual abuse and of the organizational failures which allow such abuse to occur. Cases which once might have been defensible due to community goodwill, and a general sense that there are limits to how much can be done to prevent abuse, are now much more likely to end up with organizations partially or primarily at fault.
While RBAC was not the instigator, these events did occur while the child was under the center's care. And there were several measures which RBAC could have taken that would have greatly reduced the likelihood of abuse. According to the court, there were two major concerns with RBAC's practices:
