There are less than 72 hours until the government runs out of funding. Neither chamber has passed a bill, and House Dems leave tomorrow for their annual retreat. The House votes today on a bill to fund the government until March 23rd. But that doesn’t mean much since the Senate will likely say nah. Thursday is also a critical marker in the DACA debate. As part of the deal to reopen the government last month, Senate Majority Leader Mitch McConnell (R-KY) promised to bring immigration reform to the floor for debate this month as long as the government is funded beyond Thursday's deadline. A group of bipartisan congressional leaders have been working toward a solution but don’t appear close to an agreement. Time for a call for unity? Not according to the White House. Speaking in Cincinnati yesterday, Donald Trump called Dem members who didn’t applaud during his SOTU address treasonous. The scary part? The audience applauded. More on that below. Now get this: Trump’s attorneys don’t want him sitting down for a wide-ranging interview with Special Counsel Robert Mueller. Why? Because 45 has a history of making false statements and contradicting himself, and they are concerned he could be charged with lying to investigators. Meanwhile, the Dow fell 1,175 points on Monday, its largest single-day point decline ever, and its volatility continues this morning. There’s a reason presidents don’t take credit or blame for the markets. And those crickets you hear are from the president’s Twitter account, who has not said a thing. But he did tweet an insult to Congressman Adam Schiff (D-CA), the top Democrat on the House Intelligence Committee, just hours before lawmakers voted unanimously to release the Democratic version of a controversial memo rebutting GOP allegations that the FBI abused surveillance laws. Trump has five days to say if he will try to block its release. In some Veep news, Mike Pence’s brother just launched a congressional run in Indiana. Cory Booker and Brian Schatz Press Jeff Sessions on Prison Terms
Senators Cory Booker (D-NJ) and Brian Schatz (D-HI) on Monday pressed the Department of Justice and the U.S. Sentencing Commission (USSC) to complete a study on the use of algorithmic risk assessment tools for determining prison terms, setting bail, and even supporting findings of guilt or innocence. The USSC failed to comply with DOJ instructions from 2014 asking for a report on the topic. In a letter to AG Jeff Sessions and USSC Acting Chair William H. Pryor, Jr., the Senators asked why the USSC has not completed the study and encouraged the agency to do so within the next six months. The initial 2014 report was requested because of the DOJ’s concern that such algorithm-based risk assessment tools were leading prison terms to be increasingly based on a person’s demographic characteristics such as age, sex, education level, family circumstances, employment status, and drug history. “There are valid concerns that some algorithms may exacerbate racial disparities by relying on socioeconomic factors correlated with race or ethnicity to set bail, determine sentencing, and even contribute to ultimate determinations of guilt or innocence. Given these concerns about fairness and transparency, we are troubled that the Commission has not taken the time to explore this issue,” the Senators wrote in the letter. Tammy Duckworth Intros HOME with Tim Scott and Ron Johnson
Senator Tammy Duckworth (D-IL)
introduced bipartisan legislation last week with Senators Tim Scott (R-SC) and Ron Johnson (R-WI). The Housing Opportunity Mortgage Expansion (HOME) Act would help ensure Federal Home Loan Banks (FHLBs) can continue their small business lending and funding of affordable housing initiatives, such as down payment assistance for low-income borrowers, by reversing a 2016 Federal Housing Finance Agency FHLB membership rule that the lawmakers say threatened to drive up costs for American homeowners. The legislation would make FHLB membership more inclusive, create more liquidity for small business lending, and increase resources for affordable housing. “By safeguarding lending options for low-income families, small businesses and farmers, we can protect economic opportunities for hardworking Americans across the country,” Duckworth said. Trump Implies CBC Members Are Treasonous
In a speech on Monday, Donald Trump implied that members of the Congressional Black Caucus and others who did not applaud during his State of the Union address were treasonous. Speaking in Cincinnati, “Can we call that treason? Why not? I mean they certainly didn’t seem to love our country very much.” The CBC credits former President Barack Obama for the Black unemployment numbers which had steadily declined for the past seven years. The most significant declines happened during the Obama administration. Trump often dismissed declining unemployment rates under Obama as false. The CBC says the White House has failed to articulate which specific policies Trump implemented that led to lower unemployment rates for Black Americans.
Just days after Trump’s SOTU address, the Department of Labor reported that the Black unemployment rate had increased by nearly a full point. POTUS45 has yet to take credit or blame for the spike, or even acknowledge the increase. More here from WaPo’s Eugene Scott.

Luján Grisham Wants a Vote to Formally Condemn GOP Colleague
Congressional Hispanic Caucus Chair Congresswoman Michelle Luján Grisham (D-NM) took to the floor of the House yesterday to introduce a resolution condemning Congressman Paul Gosar (R-AZ) for his request to have “Dreamers” attending the SOTU address arrested and deported. And because Luján Grisham was able to read the privileged resolution on the House floor, the chamber has two days to act on it and vote. While the GOP will likely seek to quash the vote, Dems can still force a procedural vote. The resolution claims that Gosar “abused his power in an attempt to interfere with and politicize the U.S. Capitol Police’s efforts to provide for a safe, secure, and open environment during the State of the Union” and violated the code of official conduct by not “behav[ing] at all times in a manner that shall reflect creditably on the House.” Stay tuned. Terri Sewell and Yvette Clarke Warn on Russia and Team on Cyber Security
It has now been a full year since the intelligence community released its declassified report on the cyber breach, confirming both that Russia executed the attacks and that Russian hackers will be back to exploit vulnerabilities in future elections. But federal lawmakers have yet to pass a single bill to protect the elections process from another attack. Congresswomen Terri Sewell (D-AL) and Yvette Clarke (D-NY) penned an op-ed for The Washington Times to highlight the seriousness of the issue. “We have been disappointed in the lack of leadership by the White House on this important issue. Instead of unifying the country following Russia’s cyberattacks, this administration established a now-defunct sham election commission in order to support President Trump’s foregone and unfounded conclusion of voter fraud,” they write. “We urge our colleagues to support and pass legislative measures that adequately protect this critical infrastructure for all communities. We also strongly urge the administration to refocus its efforts toward protecting against malicious actors, foreign and domestic, rather than advancing a false narrative of voter fraud aimed at disenfranchising millions of voters across the country.” Sewell -- a member of the House Intelligence Committee -- introduced two bills in July aimed at strengthening the cybersecurity of federal, state, and local election campaigns. The SHIELD Act would prompt the Department of Homeland Security to coordinate with political campaign committees on cybersecurity. The second piece of legislation, named the E-Security Act, would instruct the Election Assistance Commission to create a program to train campaign staffers on cybersecurity. More here.
Jayapal Leads Push for Equitable Housing
In a letter to HUD Secretary Dr. Ben Carson, Congresswoman Pramila Jayapal (D-WA) and 37 members of Congress expressed concerns over the department’s decision to delay implementation of the Affirmatively Furthering Fair Housing rule (AFFH). The Trump administration has rolled back the deadline for AFFH -- made into law under President Barack Obama -- until well after 2020. The Obama-era rule was part of an effort to strengthen a federal Civil Rights-era requirement that local governments take active steps to undo racial segregation. “We are very concerned about this decision because the AFFH is critical to ensuring that our communities have a path forward and the tools necessary to comply with the Fair Housing Act of 1968,” wrote the members. “As a country, we must be doing everything we can to ensure equal access to opportunity—central to this is housing equity.” See the letter here.

Activists Protests Lack of Latino Representation at Oscar Luncheon

(pictured), President of the National Hispanic Media Coalition, disrupted a luncheon for Academy Awards nominees on Monday at the Beverly Hilton. Protesting the lack of Hispanic characters on movie screens, he said his anger was aimed not at the Academy, but at the movie executives who were attending the Oscar luncheon. Latinos make up 18% of the U.S. population, but only 3% of speaking characters in films during the last decade were Latino. For the sixth year in a row, no Hispanic actors or actresses were nominated for Oscars. Only one Hispanic man has won the Best Actor Oscar -- José Ferrer for Cyrano de Bergerac in 1951 -- and no Hispanic woman has ever been named Best Actress. “When people think of diversity, they think of black and white,” said Moctesuma Esparza, a Producer of films such as Selena and the CEO of Maya Cinemas, a multiplex chain. “Nobody thinks of other minorities unless it is pointed out. Latinos, like all human beings, want to see themselves represented on screen.” Joining Nogales and Esparza at the protests were Santiago Pozo, CEO of Arenas Entertainment, which focuses on marketing studio movies to Hispanic audiences, and Gloria Molina, a former Los Angeles County Supervisor. NYT Names New Reporter to Metro Desk
The NYT has hired Vivian Wang as a full-time reporter on their Metro desk, covering state politics. In her new role, she is laser-focused on the NY state legislature and divides her time between Albany and NYC. Wang has served as a James Reston Reporting Fellow at the paper since last June. Prior to that, the 2017 Yale University graduate worked for her college paper, the Yale Daily News, as a News Editor. She has covered a wide range of topics, from crime to education to politics and human interest. Congrats, Vivian. More about her here.
FCC’s Mignon Clyburn Joins Senator in Call to Renew Comcast/NBCUniversal Restrictions
Democratic FCC Commissioner Mignon Clyburn wants regulators to renew behavioral restrictions on Comcast that were imposed as a condition for its merger with NBC in 2011. She is joined in her efforts by Senator Richard Blumenthal (D-CT). The two argue in an op-ed for Bloomberg that letting the conditions expire could lead to Comcast abusing its power to hurt competitors. The conditions expired last month, and some Dems worry that since FCC has repealed its net neutrality rules, it will be open season for internet providers to choose what content gets priority. “For the majority of Americans who still get their video from pay-TV providers, and for the growing number who rely on an online video distributor, the expiration of the merger conditions brings a less competitive marketplace,” the pair write. They go on to say, “The FCC should extend the Comcast-NBCU merger conditions, or impose new rules suited to the present marketplace. At a minimum, the agency must strengthen the program access rule, a regulation established by Congress to prevent unfair practices by cable operators that own programming – companies such as Comcast-NBCU or AT&T-Time Warner.” They also say it would be appropriate for the DOJ to investigate the anti-competitive threat consumers will face if Comcast-NBCU is allowed operate without basic rules of the road. Trump’s Deputy Press Sec Called Him Deplorable
Before joining the Trump administration, the White House Deputy Press Secretary Raj Shah called Donald Trump “a deplorable” and referred to the release of the Access Hollywood tape as “some justice,” according to private messages independently obtained and verified by New York Magazine. Shah, who worked at the RNC during the 2016 election, also asked a fellow colleague to dig up an old video clip of Trump that shortly afterward showed up in a Jeb Bush commercial. In recent weeks, Shah has had increased visibility, regularly appearing on TV as a White House surrogate. A senior White House official said that Shah had previously informed “his superiors in the administration” about the messages. Communications Director Hope Hicks replied in a statement that read, in part, “Perhaps if the leakers trying to undermine him were as talented and smart as Raj, they would be here fighting for the American people every day, rather than trying desperately to remain relevant by spreading information that Raj himself shared many months ago.” More here.
Important Border Wall Case Will Be Heard By Judge Trump Belittled

-- whom Donald Trump infamously attempted to diss by calling him a “Mexican” and a “hater” because of his heritage -- will hear a case on Friday that could determine whether Trump can waive environmental laws for his proposed border wall. The case consolidates three lawsuits filed last year by the state of California, environmental groups, and Congressman Raúl Grijalva (D-AZ) which challenge waivers granted by Congress in 1996 and 2005 that let the federal government circumvent some federal and state laws, including environmental regulations, in the name of border security. McClatchy reports that if Curiel rules against the administration, it could hamper Trump’s immediate border wall ambitions. Read more here.

Dems Huddle with Eric Holder, Preet Bharara, and Others
The Democrats are kicking off their annual retreat tomorrow in Cambridge, MD. Former AG Eric Holder and former VP Joe Biden will both serve as keynote speakers. Participants will also hear from former U.S. Attorney Preet Bharara, who was fired by Trump, and DNC Chairman Tom Pérez. The theme for the retreat is "United for A Better Tomorrow." Topeka, KS Mayor Michelle De La Isla, who is the state’s first Latina Mayor, and Hoboken, NJ Mayor Ravi Bhalla, who is the state’s first Sikh Mayor, will both speak on a panel on “Changing the Landscape.” There’s also a panel about “Engaging all Communities” -- which includes representatives from the Latino Victory Fund -- as Democrats look to build a diverse voter base ahead of the midterms. Dems will need to scoop up 24 seats to take back the House this year. And with the election of Senator Doug Jones (D-AL), the upper chamber is also now very much in play. Assuming they defend all 26 of their own seats in the Senate (which will be no easy task), there are then two Republican-held seats -- Nevada and Arizona -- that have surfaced as possibilities. Senator Dean Heller (R-NV) is a target and Senator Jeff Flake (R-AZ) is retiring. Dems will have to figure out how to energize their base and attract new members of the electorate frustrated with the process. More here.
Cortez Masto Calls for Hearing on Housing Aid for Puerto Rico
Senator Catherine Cortez Masto (D-NV) is urging the Senate Banking, Housing, & Urban Affairs Committee to hold an oversight hearing on the housing crisis facing Puerto Rico post-Hurricane Maria. The Senator calls for a hearing to determine whether HUD’s assistance has been adequate and whether Puerto Ricans have access to federal borrower protections. In a letter to committee leadership, Cortez Masto wrote that “[w]hile the end of the Department of Housing and Urban Development’s moratorium preventing evictions and new foreclosure proceedings on certain loans is approaching in March, many banks have already ended their moratoriums, meaning foreclosures are set to drastically skyrocket.” See her letter here.
Rubio and Nelson Urge FCC to Continue Work on Telecom in Puerto Rico
At the end of last week, Senators Marco Rubio (R-FL) and Bill Nelson (D-FL) urged the FCC to continue to work with the Puerto Rico Telecommunications Regulatory Board to restore connectivity across the island. “The ability to communicate with friends and loved ones is critical in the aftermath of a major storm. We strongly urge you to consider the unique challenges residents on the island continue to face, and work closely with the government of Puerto Rico to expedite the restoration of telecommunications services.” See their letter here.

Kresge Foundation Names New Program Officer
The Kresge Foundation has announced the appointment of Tatiana Hernández, a board member of Grantmakers in the Arts, as Senior Program Officer with the Foundation’s Arts and Culture Program. The 2001 George Washington University graduate is no stranger to the foundation space. She previously was a Program Officer with the John S. and James L. Knight Foundation, based in Miami. Before that, she was in LA, where she worked as a Development Manager for Green Dot Public Schools. “I made a commitment early in life to work on projects in service of people, for social good. So, it’s no surprise my work has required an intentional approach to relationship building,” Hernández said. The Kresge Foundation is a philanthropic private foundation headquartered in Troy, MI. They work to expand opportunities in cities through grantmaking and investing in arts and culture, education, environment, health, human services, and community development efforts. Congressional Black Caucus Foundation Honors Colin Powell 
The Congressional Black Caucus Foundation, Inc. will honor General Colin Powell this month at the organization’s annual AVoice Heritage celebration. This year’s theme, “Black Veterans on the Front Lines of History”, will honor “the unwavering patriotic resilience, commitment and sacrifices of African Americans to the values of freedom, democracy, and justice from the battlefield to the halls of Congress.” Powell will be joined in the honor by Sergeant Millie Dunn Veasey, a 100-year-old female veteran who served in World War II; Ginger Miller, a military veteran who was once homeless and who founded John 14:2, a nonprofit organization that has a core mission to assist military veterans and their families experiencing homelessness, substance abuse, and mental illness; and current Congressional Black Caucus (CBC) veterans. The following CBC members will be honored: Sanford D. Bishop, Jr. (D-GA) [U.S. Army], Eddie Bernice Johnson (D-TX) [Nurse Veteran], Bobby L.
