“Queen of the Hill” Petition Stalls but GOP Moving Forward With Votes on Conservative-Leaning Immigration Bills
House Speaker Paul Ryan (R-WI) late Tuesday night announced that the lower chamber will vote on two immigration bills next week: the conservative measure drafted by Judiciary Chairman Congressman Bob Goodlatte (R-VA) and another compromise package still being put together by Ryan and other party leaders that attempts to marry proposals by moderates and conservative GOPers, which will likely include some fix for “Dreamers” and additional resources for border security. The votes on the two bills stop the “Queen of the Hill” petition that was being pushed by moderate Republicans and Democrats -- they remained two votes short of the 218 signatures needed to force a vote on other bipartisan bills. House Dems had all signed onto the petition after the last party holdout, Congressman Henry Cuellar (D-TX), joined the effort yesterday. Congressman Carlos Curbelo (R-FL) one of the moderates leading the effort on the discharge petition, defended their work and said the push had successfully pushed House leadership for a vote on immigration. "We think that at some point the group has to trust that the leadership has refereed these discussions for a number of weeks and that based on all the information that they have on the many points that we've agreed on, that they can begin putting a product together for consideration on the floor of the House," Curbelo said. However, Dems jumped on their moderate colleagues’ inability to deliver the votes needed to vote on more moderate proposals to protect “Dreamers.” “House Republicans’ latest failure to deliver for Dreamers is made all the more inexcusable by their many empty promises that they would get the signatures and move on the discharge petition,” said Javier Gamboa, a spokesman for the DCCC. “If vulnerable members like Carlos Curbelo, Will Hurd and Jeff Denham can’t get the job done with their party controlling all of Washington, they have no business serving in Congress.” The Congressional Tri-Caucus is holding a news conference on immigration today at 11:15A in response to Ryan’s announcement. Keith Ellison Intros Bill to Rein in Stock Buybacks
Congressman Keith Ellison (D-MN) on Tuesday introduced the Reward Work Act, which would prevent companies from buying back their own stocks on the open market and require that workers have a voice on corporate boards. "Large corporations have used their recent tax break to close plants and offshore jobs, all while spending record billions on buybacks to enrich their own executives,” Ellison said. “Workers deserve a larger share of the profits they produce and a seat at the table, and this law will make sure they get it.” Ellison's bill would bar companies from offering stock buybacks on the open markets. Instead, buybacks would have to be done through tender offers, which face more disclosure requirements. The bill also would require public companies to have their workers chose one-third of their boards. Ellison -- who also serves as Deputy Chairman of the DNC and is running for Attorney General of Minnesota -- uses Walmart as an example. He says the company recently announced $20 billion in stock buybacks while the minimum wage is $11, below the federal poverty line for a family of three. He suggests that if the company were not delivering $20 billion to shareholders and instead invested that money in workers, it could raise wages $5.66 an hour to a base wage in excess of $16 an hour. Kamala Harris and Nydia Velázquez Intro Bill to Avoid Death Toll Miscounts from Natural Disasters
Senator Kamala Harris (D-CA) and Congresswoman Nydia Velázquez (D-NY) on Monday introduced legislation that would create a standard federal process to determine fatalities after a natural disaster. The Counting Our Unexpected Natural Tragedies’ Victims Act comes on the heels of a Harvard study published in the New England Journal of Medicine last month that estimated that 4,645 deaths could be linked to Hurricane Maria -- almost 70 times higher than the Puerto Rican government’s original death toll of 64. If passed, the bill would authorize $2 million for FEMA to contract with the National Academy of Medicine to conduct a study on how to best assess mortality during and in the aftermath of a natural disaster -- a process currently left up to individual states and territories. Both lawmakers argued that accuracy and transparency are essential, as it influences the urgency of federal response efforts, and the amount of aid disaster victims can receive from FEMA. “Whether it be Hurricane Maria or another natural disaster to come, the accuracy of the death toll has a direct impact on an area’s recovery,” said Harris. “We cannot allow our government’s failed response in Puerto Rico to ever happen again.” Velázquez weighed in saying death tolls influence public perception about the scope of a disaster and often determine what federal resources are allocated for a response. “Tragically, in Puerto Rico, the official death toll has been vastly undercounted, driving a narrative that has enabled the Trump Administration to brag about its response to Maria, while our fellow citizens were dying. Doris Matsui Intros Bill to Support Drug Companies Providing Outpatient Meds at Reduced Prices
Congresswoman Doris Matsui (D-CA) on Tuesday introduced legislation that clarifies the intent of the 340B Program -- a federal government program that requires drug manufacturers to provide outpatient drugs to eligible health care organizations and covered entities at significantly reduced prices. No state or federal dollars are involved with this program. Drug manufacturers provide the discounts directly to eligible hospitals and other providers. The Stretching Entity Resources for Vulnerable Communities Act aims to enhance the program’s integrity and protect and expand the program to meet the needs of the opioid crisis. Among the key components of the bill is the requirement that the Secretary of Health and Human Services audit 340B health care providers as well as drug manufacturers, and mandates that drug manufacturers publicly disclose drug pricing information. Additionally, the act will reverse a January cut in Medicare payments to 340B hospitals for their purchase of outpatient drugs. Hospitals and clinics doing life-saving work rely on the 340B Program to help them provide inclusive and affordable care in their communities,” said Matsui. “Unfortunately, the program is being incorrectly used as a scapegoat for high drug prices by the Trump Administration. This legislation makes clear the importance of preserving the program so safety net providers can continue to serve low-income and vulnerable patients, while expanding it to help address the opioid crisis.” More here.

Mazie Hirono and Tammy Duckworth Say Pruitt’s Interior Delaying Key Grants
Senators Tammy Duckworth (D-IL) and Mazie Hirono (D-HI) say that Secretary Ryan Zinke’s Department of the Interior (DOI) is delaying giving out key grants due to review procedures that “appear to be driving the lack of efficiency and effectiveness in carrying out DOI’s statutory responsibility.” DOI late last year began a process of reviewing numerous grants it has been giving, including money to nonprofits and universities, in order to ensure that the grants fit with Trump administration priorities. A political appointee has been put in charge of vetting payments of more than $50,000. The senators charge that the resulting delays have created “the appearance of improper political interference in program decisions that should always be merit-based.” They write in their letter, “We are concerned that this type of increased political review will result in unnecessary delays, uncertainty for key partners, and, potentially, undue political influence in the evaluation of proposals.” A DOI spokesperson defended the practice on Tuesday in response to the letter, but the Senators still want more information about the review, timeline, and how grants and organizations are being evaluated. Menéndez Uses National Defense Authorization Act to Target Trump Admin
The Senate this week is considering the National Defense Authorization Act (NDAA), and Senator Bob Menéndez (D-NJ) is taking the opportunity to introduce amendments to the bill targeting the Trump administration. On Monday, the Ranking Member of the Senate Foreign Relations Committee, introduced an amendment to the NDAA that would require the President, Vice President, and Cabinet Members who review the impact of foreign investment in the U.S. on national security, to disclose every 90 days all private business transactions they have with foreign entities. Then on Tuesday, Menéndez introduced a second amendment calling on Donald Trump to immediately retract his statement regarding the Russian Federation rejoining the G7. The amendment would also require Trump to clearly state that the Russian Federation will “never join the G7 until it fully ceases efforts to undermine the rules-based international order and ends its illegal occupation of Crimea.” The 64-year-old son of Cuban immigrants also announced that he is introducing a separate Senate Resolution that will express the Senate’s support for the G7’s focus on shared priorities of trade, economic growth, national security, and sustainability, in response to Trump’s refusal to sign the G7 joint communique. Catherine Cortez Masto Raises Alarm Over Potential China Threat
Senator Catherine Cortez Masto (D-NV) and a bipartisan group of senators sent a letter to the Trump administration, raising concerns about what they say is China’s attempts to undermine democratic institutions in the U.S. and supplant American leadership and alliances abroad. The Senators called on Secretary of State Mike Pompeo, Defense Secretary James Mattis, Treasury Secretary Steve Mnuchin, National Intelligence Director Dan Coats, FBI Director Christopher Wray, and U.S. Agency for International Development Administrator Hank Green to develop a comprehensive strategy to counter Chinese actions, which the lawmakers say aim to manipulate public discourse and democratic institutions in support of China’s interests. In the letter, they cited several cases where organizations and individuals with ties to the Chinese Communist Party (CPP) have attempted to exert undue influence over media outlets and academic institutions -- in the U.S. and abroad -- to serve China’s political interests. “We are concerned that while some of these efforts may seem innocuous when taken independently, collectively they represent an attempt to increase the appeal of autocracy and strengthen Chinese leverage over U.S. allies,” they wrote. “China's long-term objectives with these operations are to undermine liberal democracies, erode the strength of U.S. alliances... [and] supplant U.S. leadership in the world.” Joining Cortez Masto in signing the letter were Senators Marco Rubio (R-FL) and Ted Cruz (R-TX), among others. More here.

Primary Results Recap
Former Congressman Steven Horsford won his Democratic primary on Tuesday night in his bid to represent Nevada’s 4th Congressional District. He will faceoff with Republican Cresent Hardy -- for the second time. Horsford lost his seat to Hardy in 2014 who then lost his seat to Congressman Rubén Kihuen (D-NV) in 2016. Kihuen is not seeking re-election. Horsford wasted no time drawing battle lines against his familiar opponent. "This November, Nevadans will have a choice between decency, civility, and solutions or an NRA-endorsed shill for Donald Trump. We cannot afford a congressman who voted against common sense background checks to stop criminals, the mentally ill and suspected terrorists from obtaining deadly weapons; who has advocated for raising the retirement age to 75; and who has voted to strip health care away from millions of Americans,” he said. "I’m running to represent Nevadans, not just as a check on this out of control White House, but as a tireless advocate who will find solutions for all of us." Also of note, Nevada Senate Majority Leader Aaron Ford claimed victory in the Democratic primary in his bid to be Nevada’s next Attorney General. He will face former Assistant State Attorney General Wes Duncan in November. In South Carolina, Democrats State Rep. Robert Williams and Mal Hyman have advanced to a runoff for the Democratic nomination for the 7th Congressional District in South Carolina. The winner of the June 26th runoff will face Republican Tom Rice. Of note, Williams is also running to keep his seat at the Statehouse from the area around Darlington. And in the 4th Congressional District, Democrats businessman Brandon Brown and accountant Doris Lee Turner will also meet in a runoff to determine which of the two will face Republican Lee Bright. In Virginia’s First Congressional District, a strategic analyst for a federal contractor and mother of six, Vangie Williams has won the Democratic primary. Tom Pérez and Fellow Dems Ask Entertainers for Help with Messaging
DNC Chairman Tom Pérez, several House members, and other top elected officials are meeting with a group of 35 members from the entertainment industry to get help with voter turnout and messaging ahead of the midterm elections and 2020 presidential campaign, according to Politico. The group was formed in the wake of the 2016 election and participants say they are developing programs targeting young people, Black voters, and Puerto Ricans displaced by Hurricane Maria -- a significant voting bloc in Florida and other key states. The roundtable is comprised of producers, show-runners, executives, directors, an animator, and actors such as Rosemarie DeWitt, Ron Livingston, Jason George, Alyssa Milano, and Helen Hunt. “Right now, this is a lot of connecting us to talent and other influencers who have a large social media following or are well known in various communities in order to help us engage voters and highlight the importance of voting,” said DNC Comms Director Xochitl Hinojosa. “These are creative influencers that are bringing to the table their creative minds in order to best reach out to these voters.” More here.

Julián Castro Joins Board of Voto Latino to Help Register 1 Million Voters
Former HUD Secretary Julián Castro has joined the board of Voto Latino just as the group, who is committed to engaging and empowering Latinos in politics, is preparing to roll out a campaign to hit 1 million registered voters by 2020. “I gently remind people that once Latinos register, their chance of coming out to vote is 80%,” said María Teresa Kumar, Voto Latino’s President and CEO. “The game is going to be played in seven states.” The new initiative is called Somos Más (We Are More) and will focus on Texas, Nevada, Colorado, Arizona, New Mexico, Florida, and California. Their targeted sites will include 27 college campuses. They’ll also have a digital effort concentrated on North Carolina, Ohio, Georgia, and Pennsylvania. They have raised $4 million of their $7 million goal. “It has always been our strength -- the richness of our diverse communities and the histories of our people that have guided us,” Castro said. “2018 will be the moment Americans decide what kind of country we want to live in and leave for the next generation.” Joining Castro on the board is Sonal Shah, an economist who served as the Director of the Office of Social Innovation and Civic Participation in the White House under President Barack Obama, and DC attorney Brian Stansbury. Obama’s Political Committee Mobilizes for Midterms
Organizing for Action, the political committee formed by former President Barack Obama, is preparing to mobilize for the 2018 midterm campaign. NYT reports that the group will be targeting more than two dozen congressional races and several key state elections with a program aimed at turning out Democratic-leaning voters deploying organizers in 27 Republican-held congressional districts. They will also focus on several elections that may affect the redrawing of the congressional map after the 2020 Census including races for governor in Florida where FAMU graduate and Tallahassee Mayor Andrew Gillum is running. The group is also eying the gubernatorial race in Wisconsin and redistricting-themed ballot referendums in Colorado and Michigan. Organizing for Action previously announced it would partner in 2018 with Eric Holder’s National Democratic Redistricting Committee to combat legislative gerrymandering in the midterms. Obama does not have a formal role with Organizing for Action, but the group is directed in large part by his former advisors. More here.

DOJ Handed Rare Antitrust Loss as AT&T-Time Warner Merger Approved
A federal judge on Tuesday approved AT&T's $85 billion purchase of Time Warner, handing Donald Trump’s administration and its top DOJ antitrust lawyer, Makan Delrahim, a rare loss on the issue. Federal Judge Richard Leon said that Delrahim and DOJ failed to provide sufficient proof that the deal would harm competition or consumers. In his ruling, he also warned the federal government against bringing an appeal if it was just trying to prevent the deal without a change in its legal basis, though the DOJ has not announced its next steps. In a statement, Delrahim said he was “disappointed” in the ruling and said DOJ would “consider next steps in light of our commitment to preserving competition.” Trump has repeatedly spoken out against the merger, which WaPo says is due in no small part to his opposition to CNN, which is owned by Time Warner. FCC’s Ajit Pai Faces Questions from Senators Over John Oliver Incident
Senators Brian Schatz (D-HI) and Ron Wyden (D-OR) sent FCC Chairman Ajit Pai a list of questions about the incident last year during which the agency’s comment-filing website was taken offline after the late-night comedian John Oliver urged his audience to flood it with pro-net neutrality comments. As reported last week, FCC officials were already facing accusations that they lied to several news organizations about the cause of the outage. The agency maintains that its system was hit by multiple distributed denial-of-service (DDoS) attacks, but it hasn't provided evidence publicly to support that claim. Internal emails reviewed by Gizmodo lay bare the agency’s efforts to counter rife speculation that senior officials manufactured a cyber attack, allegedly to explain away technical problems plaguing the FCC’s comment system amid its high-profile collection of public comments on a controversial and since-passed proposal to overturn federal net neutrality rules. “[H]ave any subsequent FCC or third-party (e.g., vendor, contractor, or government agency) analyses or investigations verified that a cyber attack on ECFS occurred in 2017 and, if so, that the attack is best classified as a [distributed denial of service] attack?” the senators ask in their letter. “If not, why was no investigation conducted? Please provide any and all reports, findings, and other relevant details of any such investigations.” They asked that Pai respond to their questions by June 27th. More here.

Education Department Received Hundreds of Complaints About Racist School Discipline
As Education Secretary Betsy DeVos considers revising or rescinding Obama-era guidance meant to protect students from racist punishments, the Department of Education received more than 200 civil rights complaints last year involving students who say they were victims of racist school discipline. Students of color are often disciplined more harshly than their white counterparts. Black students only make up about 16% of all public school students but account for about 40% of those who receive school suspensions, according to a report from the Government Accountability Office. And they are significantly more likely than white students to be expelled, arrested at school or referred to outside law enforcement personnel. Another study released in 2017 found that Americans overall view Black girls as less innocent and more mature for their age. The Education Department’s Office for Civil Rights investigates complaints from students and families who have experienced such discrimination under Title VI, the federal law that protects against discrimination based on race, color or national origin. In April, the office began dismissing hundreds of civil rights complaints under a new protocol that allows investigators to disregard cases that are part of serial filings or that they consider burdensome to the office. Western Growers Association Taps Government Affairs Specialist
Tracey Chow has left her post as a Legislative Assistant for Congressman Jeff Denham (R-CA) to join Western Growers Association (WGA) as their new Government Affairs Specialist. The 2011 California State University-Fresno graduate previously worked on Capitol Hill as a Legislative Correspondent for five years after a stint as a Field Representative for the California Republican Party. The WGA represents family farmers who grow fresh produce and tree nuts in California, Arizona, Colorado and New Mexico. The issues they advocate on include farm labor regulation, immigration and guest worker programs, environment and sustainability, pest control, and water. They recently came out against legislation introduced by Congressman Bob Goodlatte (R-VA) which, among other things, aimed to reduce legal immigration by 25 to 40% criminalizing illegal presence in the U.S. They said the bill’s 410,000 annual guestworker limit too low and would worsen the worker shortage crisis for farmers throughout the country.
