Agency Rulemaking Highlights
Notable ActionsAutomatic Emergency Braking Systems The National Highway Traffic Safety Administration issued a final rule to grant parts of petitions for reconsideration of a May 9 final rule that requires automatic emergency braking (AEB) and forward collision warning (FCW) systems on all new light vehicles. This final rule clarifies requirements applicable to FCW visual signals and audio signals, corrects an error in the test scenario for obstructed pedestrians crossing the road, and removes superfluous language from the performance test requirement for lead vehicle AEB. Effective January 27, 2025.
Organ Procurement and Transplantation The Department of Health and Human Services (HHS) issued a final rule to remove clinical research and institutional review board requirements for transplantation of kidneys and livers from donors with HIV to recipients with HIV. This rule reflects the Secretary’s determination under the HIV Organ Policy Equity Act. Effective November 27.
Powered-Lift Air Flight Regulations The Federal Aviation Administration finalized a rule to adopt permanent amendments and a Special Federal Aviation Regulation for a period of ten years to: facilitate the certification of powered-lift pilots by adopting alternative frameworks, clarify operating rules applicable to operations involving a powered-lift, and finalize other amendments necessary to integrate powered-lift into the National Airspace System. Effective January 21, 2025.
Refugee Child Abuse and Neglect HHS issued an interim final rule describing how its Office of Refugee Resettlement (ORR) shall investigate and substantiate allegations of child abuse and neglect occurring in certain ORR care provider facilities, and maintain a registry of perpetrators relating to certain sustained allegations. Effective December 27, and comments due January 27, 2025.
Child Pornography Victims Reserve The Department of Justice issued a final rule implementing the Amy, Vicky, and Andy Child Pornography Victim Assistance Act of 2018. The Act created the Child Pornography Victims Reserve to provide monetary assistance for victims of child pornography that formed the basis for certain convictions. Effective November 25.
Final Scientific Integrity Policy The Department of Health and Human Services (HHS) published a policy statement outlining the purpose and core values that inform the agency’s work. In the policy, HHS states its commitment to using “accurate, complete, and timely scientific and technical information” and well-established scientific processes to inform its work enhancing the health and well-being of the country. Effective October 16.
Medicare and Medicaid Programs The Centers for Medicare & Medicaid Services finalized a rule to revise the Medicare Hospital Outpatient Prospective Payment System and the Medicare Ambulatory Surgical Center payment system for calendar year 2025. This rule also updates the requirements for quality reporting programs, narrows the description of “custody” in the Medicare payment exclusion rule, and revises the special enrollment period criteria for formerly incarcerated individuals, among other provisions. Effective January 1, 2025.
