Notable ActionsEnergy Conservation: Commercial Refrigerators and Freezers The Department of Energy (DOE) issued a notice of data availability and request for comment regarding updated analysis related to its October 2023 notice of proposed rulemaking (NOPR) on commercial refrigerators, freezers, and refrigerator-freezers. DOE’s revised analysis incorporates feedback received on the October 2023 NOPR. Comments due September 27.
Brokered Deposit Restrictions The Federal Deposit Insurance Corporation is proposing to revise its regulations relating to the brokered deposits restrictions that apply to less than well-capitalized insured depository institutions. The proposed rule would revise the “deposit broker” definition, amend certain provisions related to the “primary purpose” exception, and clarify when an insured depository institution can regain status as an “agent institution” under the limited exception for a capped amount of reciprocal deposits. Comments due October 22.
Use of Consumer Reviews and Testimonials The Federal Trade Commission issued a final rule regarding the use of unfair or deceptive practices involving consumer reviews or testimonials. Among other things, the rule prohibits selling or purchasing fake consumer reviews, buying or selling positive or negative consumer reviews, and insiders creating customer reviews without disclosing their relationship to the organization. Effective October 21.
Medicare Updates The Centers for Medicare & Medicaid Services issued a final rule to make several policy changes related to Medicare programs, including hospital inpatient prospective payment systems, graduate medical education, and the long-term care hospital prospective payment system. Effective October 1.
Gender Neutrality Language in Federal Management Regulation The General Services Administration (GSA) issued a final rule amending the Federal Management Regulation to replace gender-specific pronouns (he, she, his, her, etc.) with non-gendered pronouns. GSA indicates that these changes are grammatical and do not result in added costs or associated policy changes. Effective October 21.
