Notable Actions

Oil and Natural Gas Sector Climate Review
The Environmental Protection Agency (EPA) issued a final rule to reduce air pollution emissions from the crude oil and natural gas source category.  The rule finalizes revisions to the new source performance standards regulating greenhouse gases and volatile organic compounds, finalizes emissions guidelines under the Clean Air Act for states to establish performance standards for existing sources, implements actions related to the disapproval of the
2020 final rule under the Congressional Review Act,  and finalizes a protocol for optical gas imaging. Effective May 7.
Defense Industrial Base Cybersecurity Activities
The Department of Defense issued a final rule revising the eligibility criteria for the voluntary Defense Industrial Base Cybersecurity Program. The revisions will allow defense contractors who own or operate unclassified information systems to benefit from bilateral information sharing. Effective April 11. 
Energy Conservation Standards
The Department of Energy (DOE) issued a proposed rule and a direct final rule issuing amended energy conservation standards for clothes dryers. Comments on the proposed rule are due July 1. The direct final rule will be effective July 10 if no adverse comments are received by July 1. 
In response to the Fifth Circuit Court of Appeals granting a petition for review of a final rule, DOE also issued a request for information on whether “short-cycle” product classes for dishwashers, clothes washers, and clothes dryers are warranted under the Energy Policy and Conservation Act. DOE solicits information and data to determine whether “short cycle” products are available in the market and whether they should be subject to different standards than products without a “short cycle” as the normal cycle. Comments due April 10. 
Accidental Release Prevention Requirements
EPA issued a final rule amending its Risk Management Program regulations with regard to requirements for the accident prevention program, improvements to the emergency preparedness requirements, and improvements to the public availability of chemical hazard information. Effective May 10. 
Exception for Shared Equity Loans
The Federal Housing Finance Agency (FHFA) issued a final rule to amend regulations on Fannie Mae, Freddie Mac, and the Federal Home Loan Banks to prevent them from purchasing, investing in, accepting as collateral, or otherwise dealing in mortgages on properties encumbered by certain private transfer fee covenants. Such transactions can only occur if the loans meet the shared equity loan program requirements for Resale Restriction Programs in the FHFA’s Duty to Serve Regulation. Effective May 13.
Buy America Requirements for Manufactured Products
The Federal Highway Administration issued a proposed rule to discontinue its general waiver of Buy America requirements for manufactured products and establish standards for applying Buy America if the waiver is discontinued. Comments due May 13.
Ensuring Safe Accommodations for Air Travelers With Disabilities Using Wheelchairs
The Department of Transportation issued a notice of proposed rulemaking to strengthen the implementation of the Air Carrier Access Act to address problems with mishandled wheelchairs and scooters and improper transfers to and from aircraft seats, aisle chairs, and personal wheelchairs by air carriers. Comments due May 13.
