Direct Primary Care Agreement (DPCA) Clarification:
The Tennessee General Assembly passed the “Health Care Empowerment Act" this year and it was effective July 1, 2016. The TMA Legal Department offers clarification on this new law online here. This law states that direct primary care agreements or DPCAs:

  • Are NOT considered insurance;
  • May be entered into by a patient and a physician and doing so does not forfeit the patient’s insurance benefits by paying the physician directly;
  • Allow a physician to bill a patient directly as long as the physician and patient have entered into a DPCA.
