Good Evening:
From the E-Mail Bag: Have you tackled the tricky waters of non-competes and podcasts? A reader writes to IRW:
My show does a daily podcast, which consists of show segments, but no music or commercials. It's on the radio station website. I've been thinking of doing a podcast completely separate from the broadcasting company, including possibly going live on YouTube. Podcasts aren't described as a type of "broadcasting," and my non-compete specifically bans me working for a competing media company in a county that touches the county I work today. So, my thoughts were:
I could do a podcast and not be in violation of my non-compete, but whatever I say on the air, on a podcast or on social media could always result in being fired. There's no safety net.
I couldn't sell any ads on that podcast or voice any ads while also still working for the station and if I left, until the end of my non-compete.
Live video could be considered broadcasting, and that could be in violation.
If I recorded the podcast outside of a county that's restricted, wouldn't that satisfy the terms of the deal?
If you have a comment on this, please e-mail me.
