IP Osgoode is delighted to congratulate Professor David Vaver on being inducted into the Order of Canada. Professor Vaver was acknowledged, on the eve of Canada Day on July 1, “for his leadership in intellectual property law as a scholar and mentor”.
Giuseppina D’Agostino is the Founder & Director of IP Osgoode, the IP Intensive Program, and the Innovation Clinic, the Editor-in-Chief for the IPilogue and the Intellectual Property Journal, and an Associate Professor at Osgoode Hall Law School.

Maltz v Witterick: Facing the Facts on Copyright Protection for Historic Events

During the Holocaust, a Polish Catholic single mother, Francizska Halamajowa, secreted 15 Jews away from the Nazis. Two families hid for years in the hay loft of her pigsty, while another family lived under the floor in her kitchen. She also hid a deserter from the German army in her attic. To evade suspicion, she curried favour with German officers. She even hosted dinner parties directly above the hole where one family hid.

Ms. Halamajowa’s fascinating story should be told. But, who has the right to tell it? That issue is at the heart of the recent Federal Court decision in Maltz v. Witterick.

Re Facebook Biometric Information Privacy Litigation

Canadian users of Facebook may be familiar with the process of “tagging” photos – adding the names of the people to images – but they may not be familiar with the ‘Tag Suggestion’ feature on Facebook. Tag Suggestions, which automatically scans photos uploaded to the social media site in an attempt to identify for the names of those pictured, has not been available in Canada or Europe, despite being introduced in the US in 2010, due to stricter privacy laws. The feature was the subject of a recent putative class action ruling from the United States District Court in California.

Privacy Commissioner Seeks Public Input on Consent Model

On May 11, 2016, Privacy Commissioner Daniel Therrien announced the Office of the Privacy Commissioner of Canada (“OPC”) would seek public input on the issue of how Canadians can give meaningful consent to the collection, use and disclosure of their personal information in an increasingly digital age. The OPC has released a discussion paper (“Report”) on considerations related to “enhancing” the consent model under the Personal Information Protection and Electronic Documents Act (“PIPEDA”) and a notice of consultation and call for submissions inviting all interested parties to answer specific questions related to the Report and also to provide any thoughts on issues raised. The deadline for submissions is July 13, 2016.
