An earthquake with a preliminary magnitude of 7.1 that struck Mexico yesterday has claimed the lives of more than 200 people. Hurricane Maria made landfall as a Category 4 storm in Puerto Rico this morning, slapping the island with winds of up to 155 miles an hour. Back on the mainland, the ACA repeal effort is officially the latest character on The Walking Dead. It just won’t die. The Senate left town yesterday feeling hopeful that they will overturn Obamacare despite still being short on the 50 votes needed. The House is also out, but CBC members aren’t leaving town as they kick off the Foundation’s Annual Legislative Conference today. Send us your pics! BTW, did you guys know that the Federal Election Commission allows the use of private campaign funds to pay legal bills arising from being a candidate or elected official? Well, sources say Donald Trump is taking full advantage and using his campaign funds to pay for his lawyers dealing with one of his 99 problems -- the probe of alleged Russian interference in the election. Lastly, you guys know the big concert that happens every February? And, for some reason, they have a football game around the big event? Ah yes, the Super Bowl. Obama Joins Bill and Melinda Gates Today in NYC
Today, former President Barack Obama will join Bill and Melinda Gates at the inaugural Goalkeepers Event in NYC to celebrate progress toward eliminating disease and poverty around the world, and inspire a new generation of advocates to work on behalf of these causes. Obama and Bill and Melinda Gates will be joined by activist Malala Yousafzai, Her Majesty Queen Rania Al Abdullah of Jordan, and others to recognize the remarkable advances in global health and poverty reduction over the past 25 years. Participants will share data and solutions to ensure progress continues and the ambitious targets of the Sustainable Development Goals are met. Partnerships focusing on women's empowerment, digital financial inclusion, and community health workers will be announced as "Accelerators" and tasked with speeding up progress to achieve the goals. Goalkeepers will bring together a new generation of influencers and leaders from all corners of the world who will discuss and devise innovative solutions to achieve the global goals. Gutiérrez, Grijalva, and Espaillat Arrested on Tuesday
Congressman Luis Gutiérrez (D-IL), Raúl Grijalva (D-AZ), and Adriano Espaillat (D-NY) were all arrested while rallying in defense of DACA outside Trump’s Manhattan residence with advocacy groups on Tuesday. “We’re taking the necessary steps to make it clear to President Trump, the Republicans and the Democrats that we will continue this peaceful fight for DREAMers and immigrants as long as it takes to enact legislation and put DREAMers in a safe place,” Gutiérrez, Chairman of the CHC Immigration Task Force, said in a statement. A spokesperson for Espaillat, the first former undocumented immigrant to serve as a member of Congress, said he “stood up for immigrant youth to say loud and clear — unequivocally, that he dedicates his work in Congress to protecting immigrants, immigrant families, and their future in America.” Espaillat also did a Q&A with WaPo about the “DREAMers” and the possible deal with the admin on Tuesday before his arrest. Obama Hits the Campaign Trail
Democratic sources tell The Hill that former President Barack Obama will host an event this fall for NJ gubernatorial candidate Phil Murphy. Murphy served as U.S. Ambassador to Germany from 2009 to 2013 under Obama. He also worked for more than two decades at Goldman Sachs. According to reports, it's one of several events that Obama is expected to attend in the coming weeks as he seeks to lend his star power to Democrats across the country. An event for Virginia gubernatorial candidate Ralph Northam is also reportedly in the works. Sources say Obama is likely to add more events to his political schedule through the beginning of 2018 as he readies for next year's midterms. More here.

GOP Latinos Have Beef with White House’s Jennifer Korn and Call Her the Hispanic Omarosa
Latino Republicans have a beef with Jennifer Korn, the Deputy Director in the Office of the Public Liaison and a Special Assistant to the President. BuzzFeed’s Adrian Carrasquillo reports that they feel the White House's Hispanic outreach has been ineffective and, they add, they have limited access as well. "There's a Hispanic Omarosa, and that's Jenny Korn," said Alfonso Aguilar, Executive Director of the Latino Partnership for Conservative Principles. Aguilar, who has criticized Trump over immigration policy, and other Hispanic Republicans told BuzzFeed News that their frustration is that they are often invited to non-Hispanic meetings but aren't welcome at the Hispanic events that the WH convenes somewhat regularly. Some Hispanic conservatives, however, feel there may be lingering distrust from the campaign when many of them did not support Trump's candidacy. A normally abrupt WH pushed back on this article forcefully, defending Korn with a page-and-a-half outline of the work the public liaison's office has done on Hispanic outreach. Supporters of Korn were also dispatched, saying that she is doing as well as she can in her position. They say she is understaffed and leads a no-nonsense operation. More here.
Black Lives Matter Invited On-Stage at Pro-Trump Rally
During this weekend’s “Mother of All Rallies” (MOAR) on Capitol Hill, a group of Black Lives Matter counter-protesters were invited on-stage to share their views with the pro-Trump crowd. MOAR organizer Tommy E. Hodges said to the crowd, “So what we’re going to do is something you’re not used to, and we’re going to give you two minutes of our platform to put your message out. ... It’s your right to say what you believe. And it’s their right to let you know what they think about what you’re saying.” He then turned over the mic to Hawk Newsome, President of Black Lives Matter of Greater New York. Newsome began his remarks by stating “I am an American,” a line that was met with cheers, and continued to talk about why BLM exists and how the movement is “anti-bad cop.” His remarks were met with both cheers and jeers, but overall it was remarkably civil. Obama Crashes Conference Call and Cracks the Code
On Monday, former President Barack Obama hopped on a conference call with hundreds of young people across the country to talk about the importance of coding. The goal of Monday's "National Briefing" call was to detail updates on Computer Science for All (CS), and Obama dialed in as a guest to crash the party and surprise the listeners. Over 1,000 students, educators, and advocates were on the line. "I strongly believe every child has to have the opportunity to learn this critical skill," Obama said. "We are inundated with technology and I don't want our young people to just be consumers, I want them to be producers of this technology and to understand it, to feel like they're controlling it, as opposed to it controlling them." Judge Will Not Allow Prostitution Allegations in Menéndez Trial -- Even Though His Team Wanted Them In
Judge William Walls awarded Senator Bob Menéndez’s (D-NJ) legal team a small victory when he ruled that Menéndez could tell the jury about official actions the Senator took on behalf of others and not just his co-defendant, Salomón Melgen. The legal team plans to introduce evidence showing he has intervened on behalf of many other constituents with visa and other issues during his 11 years in the Senate, just like he’s alleged to have done for Melgen. Judge Walls did rule against the Menéndez team on the issue of the Senator’s alleged use of prostitutes while he vacationed in the Dominican Republic. Menéndez’s team wanted to keep those allegations as part of the case, while the government’s attorneys wanted them gone. The Senator’s attorneys argued that the allegations provide needed context to Menéndez’s words. Politico has more here.
Hirono Tells Trump to Fill Diplomatic Appointments Key to Addressing North Korea Crisis
Senator Mazie K. Hirono (D-HI) led ten Senate Democrats in a letter calling on Donald Trump to fill the vacancies for U.S. Ambassador to South Korea (Republic of Korea or ROK), Assistant Secretary of State for East Asian and Pacific Affairs, and Assistant Secretary of Defense for Asian and Pacific Security Affairs. These key positions have gone unfilled in the over eight months of the Trump presidency. “As North Korea continues its illegal nuclear weapons program, commits blatant violations of international law, and makes threats to our country and allies, the confirmation of a U.S. Ambassador to the Republic of Korea must be prioritized to send a concrete signal to reassure not only our ROK allies but also the American people,” the letter says. In the wake of North Korea’s actions and Donald Trump’s near-war declaration at the UN yesterday, this sounds like a top priority. Read more here.

First Asian American Solicitor General Confirmed
On Tuesday, the Senate voted 50-47 to confirm Noel Francisco as the next Solicitor General. The Solicitor General is charged with representing the U.S. government before the Supreme Court. Francisco will be the first Asian American to serve in the position -- his father is of Filipino ancestry -- though Neal Kaytal served as the Acting Solicitor General during the Obama administration. Francisco received a B.A. in economics with honors in 1991 from the University of Chicago and earned his J.D. with high honors from their law school in 1996. Francisco was a clerk to Supreme Court Justice Antonin Scalia during the 1997 term. He was on the team of lawyers representing George W. Bush in the Florida recount during the 2000 presidential election, as were now-Senator Ted Cruz (R-TX) and now-SCOTUS Chief Justice John Roberts. Francisco served as Associate Counsel to then-President George W. Bush from 2001 to 2003, and then served as Deputy Assistant Attorney General in the Office of Legal Counsel until 2005. Most recently, he represented former Virginia Governor Robert McDonnell when the Supreme Court overturned McDonnell’s conviction on corruption charges in 2016. Get more here.

LendUp, a financial services firm for the emerging middle class, today announced it has appointed Jotaka Eaddy VP of Policy, Strategic Engagement and Impact, a new role designed to further the company’s commitment to social impact and advocacy for financial inclusion. Eaddy previously served as LendUp’s Head of Government Affairs. The University of South Carolina graduate has spent more than 18 years in the public sector, working as an organizer and policy strategist with organizations including the United Nations and the NAACP where she served as Senior Advisor to the organization's president, now-MD gubernatorial candidate, Ben Jealous. In addition to her work on financial issues, Eaddy has been an outspoken advocate for improving diversity in the technology sector. She has taken a leading role in LendUp’s diversity initiatives, including the launch of the company’s “Black Leaders,” “Lean In” and “LGBTQ and Allies” Employee Resource Groups. Farai Chideya Joins the Ford Foundation
Journalist Farai Chideya has worked as a reporter, political and cultural analyst, and educator. Now, she has been named Program Officer for Journalism on the Ford Foundation’s Creativity and Expression team. She has covered six presidential elections for print, television, radio, and digital outlets including CNN and the award-winning site FiveThirtyEight. The 1990 magna cum laude Harvard University graduate also co-moderated the first presidential primary debate of the 2004 election cycle. She has visited 30 nations and six continents as a reporter and for the pleasure of cultural exchange. As the child of a Zimbabwean immigrant and a Baltimore-born Black American, Farai also visits southern Africa on a regular basis for family visits and journalistic trips. “Journalism is both a force for connecting a divided America and a space where America’s divisions are apparent in our newsrooms,” Chideya said. BET Launches Political Comedy Show
In October, BET is launching a new political comedy show. The Rundown with Robin Thede will grant the network the distinction of being the only outlet giving a woman of color a voice in late-night talk. Robin will be the second female late-night host alongside Samantha Bee. Robin is noted as being the first Black woman to serve as the lead writer for the 2016 White House Correspondents' Dinner. She was also the lead writer for Comedy Central's The Nightly Show with Larry Wilmore. To celebrate the launch, BET has recruited Auntie Maxine herself. Congresswoman Maxine Waters (D-CA) will join Thede this week during the Congressional Black Caucus Foundation’s Annual Legislative Caucus for a conversation and party. Omarosa Defends WH Pick to Lead HBCU Initiative
In an interview this week, Omarosa defended the selection of Johnathan Holifield as the White House’s choice to lead the HBCU initiative. She said the WH asked stakeholders from Capitol Hill, trade organizations, and HBCUs themselves for their recommendations of candidates. She says they were looking for someone with a strong business background so they could improve on some of the issues outlined in the executive order, such as enhancing public-private partnerships. Omarosa says Holifield has the experience. “It’s really difficult to get a candidate that every single person will agree on. But the one thing they can all agree on is he has the experience and the skills to carry out the job he’s been asked to do,” she said in an interview with NBC News. Holifield has never worked in education or the federal government, nor did he attend an HBCU. “I don’t think you have to be from an HBCU to be a great manager or to carry out what’s been outlined in the Executive Order,” Omarosa said. During National HBCU Week, the Congressional Bipartisan HBCU Caucus announced the addition of eight Senate members, bringing the total membership of the bipartisan and bicameral Caucus to 62 members. The newly added members include Democratic Leader Chuck Schumer (D-NY) and Senators Tim Scott (R-SC), Sherrod Brown (D-OH), Richard Burr (R-NC), Kirsten Gillibrand (D-NY), David Perdue (R-GA), Cory Booker (D-NJ), and Tim Kaine (D-VA). “Our membership and advocacy have grown exponentially,” said Caucus co-chair Congresswoman Alma Adams (D-NC). “I’m proud to be working with Senator Booker to introduce a Senate companion bill to the House bipartisan HBCU Capital Financing Improvement Act. Capital financing is a priority for HBCUs and we now have members in both the House and the Senate who are committed to passing this and other important legislation. Menéndez Leads Fight Against Equifax
Senators Bob Menéndez (D-NJ)
, Elizabeth Warren (D-MA), Brian Schatz (D-HI), and nine Senate colleagues introduced the Freedom from Equifax Exploitation (FREE) Act to give control over credit and personal information back to consumers. They say the Equifax hack announced last week, which compromised the personal information of as many as 143 million Americans, highlighted just how little control consumers have over the collection, use, and sale of their own credit data. “Equifax violated the trust of millions of Americans by leaving their most personal data vulnerable to a breach. Worse over, the company rakes in profits from selling this personal data without consumers’ consent,” said Menéndez, a senior member of the Senate Banking Committee, which oversees credit reporting agencies. The senators say credit reporting agencies like Equifax collect personal financial data on millions of Americans and rake in billions of dollars in annual revenue selling this information to others. GOP Targets Murphy in Florida Ad Buy
Republicans have taken out a pair of online ads alleging that Congresswoman Stephanie Murphy (D-FL) is soft on terrorism. One of the ads sets a fictional terror attack at a local mall and finishes by saying that "Stephanie Murphy voted against funding to combat terrorism." The ad never mentions what Murphy voted against or why, but a spokeswoman for the NRCC told the Tampa Bay Times that it refers to her 'no' vote on the Make America Secure Appropriations Act. Most Dems voted against the bill because it included funding for a border wall. At the time that the bill was being considered, Murphy had said, "Sadly, House leadership has taken a strong bipartisan bill and contaminated it by adding a provision assigning $1.6 billion to construct a border wall. ... [It] will do nothing to keep my constituents in central Florida safe." More here.
Cummings Asks WH to Negotiate Price for Life Saving Drug in Opioid Crisis
On Tuesday, Congressman Elijah Cummings (D-MD), the Ranking Member of the House Committee on Oversight and Government Reform, led 50 Members of the House in sending a letter urging Donald Trump to negotiate lower prices for naloxone  --  a lifesaving drug used by first responders across the country to help reverse the effects of opioid overdoses. Trump established a commission in March to address the opioid epidemic, which is chaired by NJ Governor Chris Christie. They recommended naloxone be in the hands of every law enforcement officer. The price of this drug has skyrocketed in recent years. “Although state and local purchasers have been able to secure some discounts for naloxone, high prices are forcing these entities to severely ration their supplies,” the members wrote. “At this moment, you have the ability to take immediate action to implement these recommendations and make good on your promise to help save the lives of many Americans affected by this national emergency.” More here.

Leaked Memo Shows Trump Plans to Shrink Bears Ears
The Guardian got their hands on a leaked memo from Interior Secretary Ryan Zinke. It shows the president’s plans to shrink protected areas and lift restrictions on extractive developments at ten national monuments across the country -- including the sacred Bears Ears national monument in southern Utah. The area is revered by five Native nations in the Southwest: the Navajo, Hopi, Uintah & Ouray Ute, Ute Mountain Ute, and Zuni. The Navajo were removed from their homes by gunpoint in 1864 -- a dark chapter in Navajo and American history now known simply as the “Long Walk.” To this day, the Navajo Nation is the largest Indian reservation in the United States -- larger by landmass than many states. Zinke only spared one hour to meet with tribal officials when he visited Salt Lake City in May. Indigenous calls to honor this sacred place have been ignored. Admin Rejected Federal Study Showing Positive Impact of Refugees
As the Trump administration was looking for rationale to cut the number of refugees it would allow into the U.S., it rejected a study conducted by its own Department of Health and Human Services which found that refugees have a positive economic impact on the U.S. The NYT viewed a draft of the study, completed in July 2017, which found that refugees “contributed an estimated $269.1 billion in revenues to all levels of government” between 2005 and 2014 through federal, state, and local taxes. “Overall, this report estimated that the net fiscal impact of refugees was positive over the 10-year period, at $63 billion.” Ultimately, the Trump admin published a three-page report using government data that compared the costs of refugees to Americans, and made no mention of revenues contributed by refugees.
