Notable Actions

Asbestos Ban Finalized
The Environmental Protection Agency (EPA) issued a final rule that will prohibit the manufacture, import, processing, distribution, and use of chrysotile asbestos under the Toxic Substances Control Act. EPA found that chrysotile asbestos presented an unreasonable risk of injury. Effective May 28.
Worker Walkaround Representative
The Occupational Safety and Health Administration (OSHA) issued a final rule amending its Representatives of Employers and Employees regulation, clarifying who can serve as employees’ walkaround representative during OSHA’s workplace inspections. Effective May 31.
OSHA is also extending the comment period for its proposal on the Emergency Response standard. Comments now due June 21.
Petroleum-Equivalent Fuel Economy Calculation
The Department of Energy issued a final rule that revises the value for the petroleum-equivalency factor. The value will be used by EPA in calculating light-duty vehicle manufacturers’ compliance with the Corporate Average Fuel Economy standards. Effective June 12.
Emissions Standards for Integrated Iron and Steel Facilities
EPA issued a final rule that regulates hazardous air pollutants (HAP) emissions for integrated iron and steel facilities. The rule will expand the National Emission Standards for HAP to previously unregulated HAP emissions from unmeasured fugitive and intermittent particulate sources, sinter plants, blast furnace stoves, and basic oxygen furnaces. Effective June 3.
Lead Wheel Weights
EPA issued an advance notice of proposed rulemaking on the manufacture, processing, and distribution of lead for wheel-balancing weights. The action is related to ongoing litigation in the Ninth Circuit. Comments due May 3.
Climate-Related Disclosures for Investors
The Securities and Exchange Commission (SEC) issued a final rule that will require SEC registrants to provide climate-related information in their registration statements and final reports, including whether climate-related risks have or are likely to materially impact the company. Effective May 28.
