LAWSUIT TO STOP DEPARTMENT OF EDUCATION RESTRUCTURING CAN MOVE FORWARDÂ
A federal judge has denied a motion to dismiss a lawsuit challenging the administration’s efforts to restructure the Department of Education. The case, filed last March by the NAACP, the National Education Association and other groups, argues that actions such as workforce reductions, grant cancellations and an executive order exceed executive authority and interfere with statutory responsibilities assigned by Congress. In her ruling, Judge Julie Rubin stated that the court is “satisfied” that the NAACP and other groups presented a reasonable argument that the federal government has “taken direct actions” to handle the department’s funding in ways that could be unlawful.
