EDUCATION DEPARTMENT RELEASES NEW GUIDANCE ON TITLE IX ENFORCEMENT
The Education Department Office of Civil Rights (OCR) provided new guidance to help schools understand their obligations under the revised Title IX rule, put in place by former Secretary of Education Betsy DeVos. The resource “aims to assist schools, students, and others by highlighting areas in which schools may have discretion in their procedures for responding to reports of sexual harassment.” The resource also includes an appendix with examples of Title IX procedures that schools may adapt and may find helpful in implementing the 2020 amendments.
The Biden administration is still in the process of a comprehensive review of these Title IX regulations and anticipates publishing a notice of proposed rulemaking and will also issue a new question-and-answer document in the coming weeks.
