Donald Trump yesterday looked like the guy who mistakenly brought two dates to the same party. After Steve Bannon directed some criticism and threats to Senator Majority Leader Mitch McConnell (R-KY), this prompted Trump to say that he understands where Bannon is coming from with his war on the Republican establishment. But then, Trump stood side by side with McConnell in an impromptu Rose Garden appearance and the pair expressed that they’re a team. What’s not clear is who is the girlfriend and who is the side chick? Before we have another “I’m the real First Lady” incident, Trump will have to make a choice. For now, 45 has his hands full. A woman who said Donald Trump groped her has subpoenaed his campaign for documents about “any woman alleging that Donald J. Trump touched her inappropriately.” The president has denied her accusations and is fighting the subpoena. And after a stinging exposé on Sunday’s 60 Minutes, Congressman Tom Marino (R-PA) is withdrawing his name from consideration as the administration’s drug czar. Meanwhile, former VP Joe Biden presented Senator John McCain (R-AZ) with the Liberty Medal yesterday. In his acceptance speech, McCain said, “To fear the world we have organized and led for three-quarters of a century ...for the sake of some half-baked, spurious nationalism cooked up by people who would rather find scapegoats than solve problems is as unpatriotic as an attachment to any other tired dogma of the past that Americans consigned to the ash heap of history." Regardless of where you fall on the political divide, only a moron could question McCain’s patriotism. If you’re unfamiliar with the sacrifices he made for the country, google him. And when you do, take note of the Google doodle! Twenty-eight years ago today, Selena Quintanilla’s released her first studio album, “Selena.” Google pays tribute. We’re kicking off Tuesday with this...

Yes, Obama Called Families of Fallen Soldiers. Now Back to the Issue At Hand.
CNN reports that on Saturday, October 7th, the day the body of 25-year-old Army Sgt. La David Johnson was returned to Dover Air Force Base after he was killed in an ISIS ambush in Niger, Donald Trump was golfing. Since the attack, the president has directed his Twitter diatribe towards NFL players who choose to peacefully take a knee during the national anthem to highlight the country’s inequality. With a few tweets, the president changed the narrative around the protest and accused Black athletes of disrespecting the flag and the military. This president who, until yesterday, had not made a comment on the deadliest combat incident involving U.S. troops since he took office. And when he did make a comment, it was a false claim about his favorite target, former President Barack Obama. But the questions remains: When will the Pentagon provide a detailed accounting of the ambush by 50 ISIS-affiliated fighters which left four U.S. soldiers dead? How did Sgt. Johnson become separated from the party only for his body to be recovered nearly 48 hours later? And why did Donald Trump’s Twitter fingers not find the deaths of Sgt. La David Johnson, Staff Sgt. Bryan Black, Staff Sgt. Dustin Wright, and Staff Sgt. Jeremiah Johnson worth acknowledging? Stay focused. CNN offers details of the attack here.
Menéndez Trial Proceeds
Looks like the case against Senator Bob Menéndez (D-NJ) will not be thrown out. U.S. District Judge Williams Walls rejected arguments from defense lawyers that the allegations against Menéndez didn't meet the new, narrower definition of bribery under a 2016 Supreme Court ruling that reversed the conviction of former Governor Bob McDonnell of Virginia. Federal prosecutors in the Menéndez trial rested their case last week. The defense will now begin presenting its case. More here.
Trump Eyes Justice Sonia Sotomayor’s Seat
Axios reports that Donald Trump is already eyeing the seat of Justice Sonia Sotomayor. They say sources who've spoken to the president about the Supreme Court say he tells them he thinks he'll have four justices on the high court by the end of his first term. He already has Justice Neil Gorsuch. And, of course, there are the rumors that Justice Anthony Kennedy will retire. Justice Ruth Bader Ginsburg, aka the Notorious RBG, is in his sights. But, reportedly, he’s watching Sotomayor because of her diabetes. The source says 45 commented, "Her health. No good. Diabetes." Sotomayor has opened up about her struggles with type-1 diabetes, but she's managed it successfully since childhood. More here.

CBC Chair Pens Letter to NFL
On Monday morning, CBC Chair Congressman Cedric Richmond (D-LA) sent the NFL a letter urging team owners to consider the stances of protesting Black players in terms of patriotism and combating police brutality. In the more than 1,800-word letter, the Congressman invoked Dr. Martin Luther King Jr.’s 1963 Letter From A Birmingham Jail and his book of sermons Strength To Love. King sent his letter to white clergymen who believed in dismantling systemic racial injustice in the United States but disagreed with the tactics used by movement leaders. Richmond wrote, “For African Americans, it is not about standing, sitting, or kneeling for the National Anthem―it is about unarmed African Americans lying in a grave who were shot and killed by police officers,” adding, “It is also about a justice system that says that encountering a Black person is enough reason for a police officer to fear for his or her life.” Read the full letter here.
NFL Throws Weight Behind Criminal Justice Reform Bill
In the midst of the #TakeAKnee debate, the NFL has endorsed a bipartisan criminal justice bill introduced by Senators Chuck Grassley (R-IA) and Dick Durbin (D-IL) that would reduce mandatory minimum sentences for low-level drug offenders, eliminate “three-strike” rules that require life sentences, and give judges more flexibility when sentencing certain low-level crimes. “We felt that this was an issue over the last months, as we have continued to work with our players on issues of equality and on issues of criminal justice reform, that was surfaced for us, and we thought it was appropriate to lend our support to it,” NFL spokesman Joe Lockhart said yesterday. WaPo reports that this appears to be an attempt by owners to find a middle ground with players over the continued on-the-field protests. Whether these types of moves quell protests remains to be seen, but the NFL Players Association had no comment. More here.

Cortez Masto Asks Health Insurers to Work with Victims of Las Vegas Shooting
Senators Catherine Cortez Masto (D-NV) and Dean Heller (R-NV) sent a letter to top executives of America’s Health Insurance Plans and Blue Cross Blue Shield, asking that they do whatever they can to help victims of the Las Vegas shooting with any potential out-of-network charges, co-payments, and deductibles. “Given that Las Vegas is a top tourist destination visited by nearly 43 million visitors each year, many of the festival’s attendees traveled from out of state to be at the event,” the senators wrote. “As such, we fear that victims of this tragedy currently seeking badly-needed health care in the community could be hit with costly, out-of-network charges. It is our hope that insurance companies will fully comply with the spirit of the Public Health Service Act and do whatever they can to support recovering families and waive any charges that may typically apply.” Get more here.
DOJ Attempts to Strip Protections from Undocumented Children
As part of a broader attack on what it calls the “abuse” of asylum by children and families arriving from Central America, Vox reports that the DOJ is considering allowing judges to strip people who come to the U.S. as “unaccompanied children” of the legal protections that status provides if they turn 18 while they’re still in immigration proceedings, or if they’re reunited with a parent in the U.S. A report from WaPo indicates that the DOJ wants to start rating immigration judges based on how many cases they resolve -- which would put pressure on them to resolve cases more quickly and show less leniency toward immigrants. CHC Chair Names New Chief of Staff
Congressional Hispanic Caucus Chair Congresswoman Michelle Luján Grisham (D-NM) has named Natalie Armijo as her new Chief of Staff. Armijo most recently served as the Congresswoman’s Deputy Chief of Staff -- a position she held since May 2015. Before that, the New Mexico native worked as a Communications Team Lead for Creative Services at Sandia National Laboratories. After graduating from the University of New Mexico, Natalie stayed around her alma mater to earn her MBA in 2010. Luján Grisham’s former Chief of Staff, Dominic P. Gabello, left the post to run Luján Grisham's gubernatorial campaign. More about Natalie here.
Miami Politician Says She Was Abducted by Aliens -- Now She’s Running for Congress
There’s a candidate running for Congress that’s out of this world. Republican Bettina Rodríguez Aguilera, 59, is running to take the seat being vacated by retiring Congresswoman Ileana Ros-Lehtinen (R-FL). Rodríguez Aguilera has something going for her that none of the other contenders can touch: she has been aboard a spaceship run by extraterrestrials. That’s what she told a television crew during a 2009 interview. She says three blond, big-bodied beings -- two females, one male -- visited her when she was seven years old and have communicated telepathically with her several times in her life, she says. She described “going up” inside the spaceship -- though whether it went into space or just hovered around town was left unclear. “I went in. There were some round seats that were there, and some quartz rocks that controlled the ship — not like airplanes,” Rodríguez Aguilera said. According to her, the aliens let her in on some secrets: there are 30,000 skulls that are different from humans in a cave on the Mediterranean island of Malta; the world’s “energy center” is in Africa; the Coral Castle, a limestone tourist attraction in South Miami-Dade, is actually an ancient Egyptian pyramid; and “God is a universal energy.” She declared her candidacy in late August and raised about $10,000 during the most recent fundraising quarter. Slow Fundraising for Soto
Congressman Darren Soto (D-FL)
has raised just $83,000 during the last quarter for his re-election campaign in Florida’s 9th congressional district. But no need for his supporters to panic just yet. Neither of his Republican challengers have raised much of anything. The Florida Politics blog reports that the new contributions through September 30th, minus $28,000 in campaign expenses, left Soto with $222,318 in the bank, according to the latest campaign finance reports posted on the FEC website. The political landscape in Florida is expected to change rapidly as residents of Puerto Rico flock to the Sunshine State to escape Hurricane Maria's  devastation. Soto is the first Puerto Rican representing Florida elected to Congress. However, as residents of the island establish new residencies stateside, he is likely not to be the last. More here.
Anthony González Gets Boost from Peyton Manning in OH GOP Congressional Race
Former Indianapolis Colts wide receiver Anthony González is looking to fill the seat of Congressman Jim Renacci (R-OH), who is running for Ohio governor. And the Republican just got a helpful boost from his former colleagues. Supporters contributing toward his $527,744 in donations included NFL quarterback legend Peyton Manning, Chicago Bears veteran Kirk Barton, former Colts and Patriots wide receiver Austin Collie, and Cleveland Browns owner Jimmy Haslam. This collection of contributions helped González, whose family migrated from Cuba in 1960, outscore his opponents in his first quarter of fundraising for Congress and makes him the frontrunner. The Ohio State graduate spent five seasons in the NFL before retiring to go back to school and earn his MBA from Stanford University. The Beat DC first reported on his candidacy when he launched his campaign in August. More here.

Study Finds Private Sector Pipeline for Women of Color Most Challenging for Black Women
A new study, Women in the Workplace 2017, highlights the lack of diversity in the corporate pipeline. The study finds that the gap stretches from entry-level to C-suite executive jobs. It’s more pronounced for women of color generally and is particularly acute for Black women. “Women of color are the most underrepresented group in the corporate pipeline. They experience the greatest challenges. Yet they receive the least support
and efforts to increase diversity are not adequately addressing the magnitude of the issues they face,” said the report. “Compared to white women, things are worse for women of color, and they are particularly difficult for black women.” The study goes on to reveal that 31% of Black women say their managers advocate for them for opportunity, compared with 34% of Latinas, 40% of Asian women and 41% of white women. Black women feel less likely to interact with senior leaders, get advice or get stretch assignments from managers, and only 29% of Black women believe the best opportunities go to the most deserving employees. That number is 34% for Latinas and 40% of Asian and white women. More here.

Women’s March Co-Founder Booted From American Airlines Flight
Activist Tamika Mallory, co-chair of the Women’s March on Washington, claims that over the weekend she was kicked off an American Airlines flight back home to NY from Miami because of racial bias. When Tamika arrived at the Miami airport after attending the Revolt Music Conference, she changed her middle seat to an aisle at the kiosk in the airport. But there was an issue, and the ticket agent handed Mallory confirmation for the wrong seat. When Mallory questioned it, she said the agent was quite “nasty” and disrespectful.” The pilot, who had overheard a portion of the discussion, decided to intervene and asked Mallory, “Can you get on this flight? Are you going to be a problem on this flight?” To which Mallory says she replied, “No, I’m not. Actually, I’m fine. But I will write my complaint down.” She says he looked at her and said, “You’re going to get yourself a one-way ticket off this plane.” Tamika proceeded to her seat and assumed the issue was settled until a voice over the intercom summoned her to the front of the plane. Then, the pilot pointed to the activist and said: “Her, off.” As she asked why and sought to understand the dismissal, officers arrived to escort her away. Her travel companion was also removed once they witnessed the mistreatment Tamika was receiving. As a result, she missed the NY wedding of Rev. Al Sharpton’s daughter, Dominique. She’s holding a press conference this morning at 10:30A. Watch her account of the incident, first hand, here.
Marilyn Mosby Faces Challengers
Marilyn Mosby is best known for being a champion of justice when she announced charges against the five officers in the Freddie Gray case. The Baltimore prosecutor is among the one percent of all elected prosecutors in the nation who are women of color. But next year she faces opposition for the Office of the Baltimore City State’s Attorney from potential candidates Maryland Deputy Attorney General Thiru Vignarajah; Chad N. Curlett, a former New York prosecutor; and attorney Ivan Bates, who represented Baltimore Police Sgt. Alicia White in the Gray trial and is a former Assistant State’s Attorney. A super PAC composed of law enforcement, attorneys, and prosecutors was even formed in opposition to Mosby’s run for re-election. However, despite pockets of opposition, Mosby maintains a popular profile in Charm City and says she is focused on the job at hand. The Root takes a deeper look here.

Chiang Extends Sanctions on Wells Fargo for Another Year
The LA Times reports that California State Treasurer and gubernatorial candidate John Chiang will continue the state’s financial sanctions against Wells Fargo for a second year following a string of new disclosures about bad practices at the bank since its sham accounts scandal unfolded. Chiang said Monday that revelations of wrongdoing at multiple business units have undermined confidence in the San Francisco bank, which also has failed to complete necessary reforms. “The opaque manner with which the bank continues to do business and the frequency of new disclosures of wanton greed and lack of institutional control makes this decision so clear that there really was no choice at all,” he said in a statement. The sanctions suspend investments by the Treasurer’s Office in Wells Fargo securities, bar use of the bank as a broker-dealer for the purchase of investments and bar the bank as a managing underwriter for bond sales in which the treasurer has the authority to appoint the underwriter. A Pipeline Named for Pilgrims Threatens Native Americans and New York’s Water Supply
The health of 20 million people could rely on the survival of a small indigenous tribe in New Jersey. The Indypendent reports that the Ramapough-Lenape people, who have inhabited the New York region for centuries, have never been granted federal tribal recognition, thanks in part to a campaign launched by a young Donald Trump. Now, a behemoth piece of oil infrastructure, planned to stretch for 178 miles from Albany, NY to Linden, NJ, threatens to destroy what’s left of Ramapough land. And, according to reports, could potentially contaminate 90% of New York City’s water supply. Proposed in 2014 by Pilgrim Pipelines Holdings (oh, the sad irony), the $1 billion pipeline will carry 200,000 barrels of Bakken crude -- the most explosive variety of oil -- every day through land considered sacred by the Ramapough. “We’ll either last another thousand years or get wiped out entirely,” said Ramapough Chief Dwaine Perry, describing the stakes posed by the Pilgrim Pipeline for the tribe to the NYT. Prisons Ignore Senators and Policy
Despite the efforts of Senators Cory Booker (D-NJ), Elizabeth Warren (D-MA), Kamala  Harris (D-CA), and Dick Durbin (D-IL), who introduced a bill in July named the Dignity for Incarcerated Women Act that would require free hygiene products for women, there are still some prisons not in compliance. Though the bill never went anywhere, the Bureau of Prisons issued its policy memo in response, guaranteeing free feminine products. According to Vice News, some prisons are ignoring it. The federal facility in Aliceville, AL that holds nearly 1,500 female inmates is still charging women for panty liners. A federal prison in Waseca, MN that houses more than 700 inmates is still charging women for tampons and panty liners. And a female federal inmate in downtown Miami and another in Fort Worth, TX, confirmed to VICE News that those prisons are not complying with the policy either. More here.
Frederica Wilson Says Never Again After Seniors Died in FL Nursing Home
After more than a dozen senior citizens died in a South Florida nursing home due to insufferable heat following Hurricane Irma, Congresswoman Frederica Wilson (D-FL) penned an op-ed for the Miami Herald where she pledged it would never happen again. The Congresswoman established an honorary taskforce to address first response efforts at long-term care facilities. Members include congressional and state lawmakers, mayors, first responders, labor unions, advocacy groups, and long-term care providers who will work in smaller groups tasked with specific missions and goals. Congresswoman Wilson says she is also introducing legislation to require long-term care facilities that receive federal funding and resources to have a backup generator or other power source to protect residents, particularly senior citizens, from severe weather conditions. Other measures include a bill to create a grant program within the Department of Health and Human Services to fund generators and backup power source equipment for certain nursing homes and long-term care facilities, and another that would direct FEMA to prioritize assistance to such service providers in response to major disasters and emergencies. Congresswoman Wilson also plans to host a bipartisan congressional field hearing. “We are the guardians of our seniors and it’s up to us to create a safety net for them to ensure that they receive the care that they deserve,” she writes.  Read the full piece here.
