VOLUNTEER RELEASE AND WAIVER
I confirm that I requested to take part in the Americana Music Festival & Conference Volunteer program. I also confirm that I understand that this Volunteer position is non-paid. I understand that I am not an employee and do not expect to receive any pay or benefits of a Regular employee. I also understand that I have no authority, either implied or apparent, to bind the Americana Music Association (the Association) to any contracts, notes, licenses, or any other agreements.
I acknowledge that as a Volunteer with the Association, I will have and/or may in the future, come into the possession of certain confidential information and/or proprietary information belonging to the Association. The term “Confidential Information” includes, but is not limited to, all information and materials belonging to, used by or in the possession of the Association relating to members, events, Board of Directors, staff, marketing, finance and operations (hereinafter collectively referred to as “Confidential Information”). I understand that I have access to this Confidential Information only because I am a Volunteer for the Association. I acknowledge that information to which I will have access is designated as Confidential Information, and I agree that I shall not disclose this information to anyone who is not employed by the Association during or after my term as a Volunteer with the Association.
I understand that the Americana Music Association, not I, will be considered the owner of any works created/produced by me while a Volunteer with the Association. It is the Association who may enjoy the rights of these works, not the individual who created it.
I acknowledge and agree to allow my photograph, likeness and/or voice to appear in any documentary, promotional (including advertisements), television, radio or film coverage of the events without compensation or further notice, and I agree to assign all copyright or other interests therein to the Americana Music Association.
I agree that the Americana Music Association shall not be liable for any personal and/or property damage suffered by me while I am providing services to the Association. I understand that my volunteering may involve risk of physical injury to me or others, or damage to my property, or other consequences, which might result from my own actions, in actions of negligence and/or the actions, inactions or negligence of others, condition of the premises, weather conditions, or condition of any of the equipment used by the Association. There may also be other risks not known or not reasonably foreseeable. I HEREBY WAIVE AND RELEASE MY LEGAL RIGHTS TO SUE FOR ANY INJURY OR OTHER DAMAGE ARISING OUT OF OR RESULTING FROM MY VOLUNTEERING.
I understand that violation of this agreement may subject me to possible disciplinary action, up to and including my being terminated as a Volunteer for the Association, and may result in legal action being taken to enforce this agreement.
I understand that my Volunteer arrangement can be terminated, with or without cause, at any time by the Americana Music Association. In the event that a dispute arises between the Association and myself, I understand that the laws of the state of Tennessee shall be the exclusive forums in which a dispute between the parties shall be litigated.
I acknowledge that I have read and understand this entire document, and I agree to be legally bound by it.
