Cook County moves to stay order regarding “Refund Ordinance” for the Non-titled Personal Property Use Tax
On Friday, September 26, 2014 Cook County moved to stay the order granted by the Circuit Court of Cook County on Wednesday, September 17, 2014 regarding the Cook County Uniform Penalties and Procedures Ordinance (Refund Ordinance) that determined Cook County honor refund claims. The September 17th summary judgment was granted by the Circuit Court of Cook County in favor of the Chicagoland Chamber of Commerce on its count asking that the Refund Ordinance be interpreted to allow processing of refunds on the basis of the invalidity of the Non-Titled Personal Property Use Tax (Use Tax) and without the requirement that the tax be paid under protest. This summary judgment ended the litigation, apart from potential appeals.
The Cook County Board of Commissioners passed the Use Tax ordinance as a component of its budget for fiscal year 2013 on November 9, 2012. It went into effect on April 1, 2013 levying a tax “upon the privilege of using in the county non-titled personal property which is purchased outside of the county.” Click here to see the Non-titled Personal Property Use Tax Ordinance.
The recent order enables all Cook County taxpayers to take advantage of the Refund Ordinance to file claims for credit or refund of the Cook County Non-Titled Personal Property Use Tax they may have paid before the Chicagoland Chamber and Reed Smith succeeded in declaring the tax invalid.  
The County asserted that the Cook County Refund Ordinance would be granted only if the taxpayer had paid the tax “under protest.” However, the recent judgment delineates this is not a requirement to have a claim processed or refunded. According to the Refund Ordinance, “a claim for credit or refund may be filed on a form provided by the Cook County Department of Revenue within four years from the date of the remittance of the tax.” 
As of September 25, 2014 the Cook County Department of Revenue no longer accepts registration, tax return filings, and payments for the Non-Titled Personal Property Use Tax. The Chicagoland Chamber of Commerce and Reed Smith’s challenge of the Cook County Non-Titled Personal Property Use Tax will ultimately benefit many Cook County businesses and individuals.
