Notable Actions

Information and Communications Technology and Services Supply Chain
The Department of Commerce issued a final rule that responds to public comments on its January 19, 2021 interim final rule establishing procedures for its review of transactions involving information and communications technology and services designed, developed, manufactured, or supplied by persons who may pose undue or unacceptable risk to the U.S. The rule finalizes the practices guiding the review and makes certain amendments. Effective February 4, 2025.
Larger Market Participants for Digital Consumer Payment Apps
The Consumer Financial Protection Bureau (CFPB) issued a final rule to define larger participants of a market for general-use digital consumer payment applications. Larger participants of this market will be subject to the CFPB's supervisory authority under the Consumer Financial Protection Act. Effective January 9, 2025.
Medicare and Medicaid Programs
The Centers for Medicare & Medicaid Services (CMS) is proposing to revise the Medicare Advantage (Part C), Medicare Prescription Drug Benefit (Part D), Medicaid, Medicare cost plan, and Programs of All-Inclusive Care for the Elderly (PACE) regulations. Changes include coverage of anti-obesity medications, vaccine and insulin cost sharing, and regulations implementing the Medicare Prescription Payment Plan, among others. Comments due January 27, 2025.
CMS also finalized a rule to revise payment policies under the Medicare physician fee schedule and make other policy changes related to Medicare Part B payment. The rule also establishes new policies for the Medicare Prescription Drug Inflation Rebate Program, and updates the Rural Health Clinic and Federally Qualified Health Clinic Conditions for Certification and Conditions for Coverage, among other provisions. Effective January 1, 2025.
Special Immigrant Visas
The State Department issued a final rule updating its regulations governing Special Immigrant Visas to reflect statutory changes. The Emergency Security Supplemental Appropriations Act of 2021 amended the definition of a special immigrant to include the surviving spouse or child of an employee of the U.S. government abroad, provided that the employee performed faithful service for a total of 15 years or more. Effective December 10, 2024. 
Airline Passenger Rights
The Department of Transportation (DOT) issued an advanced notice of proposed rulemaking seeking comment on consumer rights for individuals experiencing significant flight disruptions. DOT is considering requirements for airlines to provide cash compensation, free rebooking, and amenities for customers with significant flight disruptions. DOT also requests comment on what types of disruptions would qualify, how passengers should receive correct information from airlines, and if certain aspects of the process should be automated. Comments due February 10, 2025. 
Comprehensive Assistance for Family Caregivers
The Department of Veterans Affairs (VA) issued a proposed rule to revise regulations governing the VA’s Program of Comprehensive Assistance for Family Caregivers. The proposal would revise definitions; criteria related to eligibility, revocations, and discharges; and reassessment processes and timelines. Comments due February 4, 2025.
