Hazardous Substances Tier II Reports are due March 1 |
|
|
If your facility stores hazardous chemicals above federal thresholds, you must submit a Tier II report under the Emergency Planning and Community Right-to-Know Act (EPCRA). This reporting helps communities stay informed about hazardous substances and ensures emergency responders can act quickly and effectively.
|
- Federal thresholds apply (see the table below).
-
Reports must be submitted electronically via E-Plan by March 1 each year.
|
|
|
-
Applies to chemicals that require a Safety Data Sheet (SDS) under OSHA rules.
- Thresholds vary by chemical type (see table below).
- Reports go to:
-
State Emergency Response Commission (SERC) via E-Plan,
- Local Emergency Planning Committee (LEPC), and
- Local fire department(s).
- Filing fee: $25 per facility.
|
| Chemical Type | Threshold | Examples |
|---|
| OSHA Hazardous Chemicals | 10,000 lbs | Paints, solvents, cleaning agents | | Extremely Hazardous Substances (EHS) | 500 lbs or Threshold Planning Quantity (TPQ) (whichever is lower) | Chlorine 100 lbs TPQ, Ammonia 500 lbs | | Gasoline Underground Storage Tank | 75,000 gallons | Gas Station | | Diesel Underground Storage Tank | 100,000 gallons | Gas Station |
|
Auto Repair & Body Shops
Reporting may be required if you store large quantities of solvents or multiple drums of flammable materials.
|
- Solvents, typically an OSHA hazardous chemical, are often stored in 55-gallon drums.
- One 55-gallon drum of solvents weighs approximately 400 lbs.
- Therefore, around 25 drums could exceed the 10,000 lbs OSHA hazardous chemical threshold, which would then require the business to complete the Tier II reporting requirements.
