The Senate has now rolled out their tax plan with alterations that would repeal the Affordable Care Act’s so-called insurance mandate. The Congressional Budget Office said this week that the repeal would lead to 13 million people losing their health insurance over the next decade. A vote is expected on Thursday. Also happening on Capitol Hill, House Speaker Paul Ryan (D-WI) announced that the House will require lawmakers and staffers to undergo anti-harassment training. The announcement comes after female lawmakers shared stories of Congressmen who have engaged in sexual harassment. Speaking of inappropriate sexual behavior, a poll released last night shows that Senate candidate and accused pedophile Roy Moore has a six-point lead over Democrat Doug Jones among Alabama voters. During yesterday’s congressional testimony, former Alabama Senator and current AG Jeff Sessions pushed back against Republicans asking that a special counsel investigate Hillary Clinton. Meanwhile, the Tri-Caucus grilled him on a litany of other issues. We break it down below. Jury Remains Deadlocked
Jurors in the trial of Senator Bob Menéndez (D-NJ) deliberated for 5 ½ hours on Tuesday without reaching a verdict. The 84-year-old Judge William Walls did not seem concerned by the length of the deliberations, saying that in his experience, jurors can take a “long, long time” to come to a decision. Politico reports that attorneys for co-defendant Dr. Salomón Melgen suggested that if the jury again says it is deadlocked, Walls should poll the foreman “as to the utility of further deliberations,” then poll the rest of the panel and then decide, after conferring with attorneys from both sides, whether calling a mistrial is appropriate. The lead prosecutor requested that if the jury remains deadlocked, Walls should instruct them that they can deliver a partial verdict if they can come to a unanimous decision on any of the counts. Walls said he had no problem with either suggestion. Defense lawyers also raised concerns that Walls’ instructions to the jury could “coerce” them into reaching a verdict. But Walls was skeptical of a defense request to inform jurors that a hung jury is an acceptable outcome. More here.
Curbelo Takes to Twitter to Hit the CHC and the Fight is Getting Uglier
Just hours after Democratic leadership insisted that the ongoing battle between the Congressional Hispanic Caucus and Congressman Carlos Curbelo (R-FL) over his request to join the CHC was just “noise,” Curbelo took to his personal Twitter account to denounce the CHC and some of its members. “Some @HispanicCaucus members are desperately & embarrassingly attempting to deflect attention from the bigotry and discrimination they espouse. The truth is that they only care about Hispanics as long as they are registered Democrats,” Curbelo tweeted. “Another desperate fabrication, this time from @RepLindaSanchez. I've never made any statements about @RepLujanGrisham's language abilities. Sanchez is looking for cover as she prepares to discriminate against a fellow Hispanic,” read another one. Curbelo also attempted to clarify the language remarks he made about speaking Spanish, which CHC Chair Congresswoman Michelle Luján Grisham (D-NM) had taken as an affront. Meanwhile, Congressman Rubén Gallego (D-AZ) tweeted, "While @carloslcurbelo may have individual values I align with the fact that he supports somebody that is detrimental to the Latino community is good enough reason for me to vote against him." Curbelo’s Comms Director Joanna Rodriguez tweeted, “Gallego rubbed his ear wax on my shoulder after removing his earpiece from an @MSNBC hit, not surprising he’s not choosing to be classy now.” Curbelo will take questions from reporters at 3P today after several House Republicans meet with DACA recipients. Obama Doodles Sell for $11,113
Former President Barack Obama can now add artist to his long list of titles. His pencil sketches, which include some self-portraits and the words Making America Competitive Again, have sold at auction for $11,113. The doodles are on a white 5x8 sheet of White House stationery. The front side of the sheet features a total of 11 drawings, two of which appear to be forward-facing self-portraits. Other doodles include a face in profile, another more cartoonish-looking face, and various shapes and squiggles. The reverse side features a few more small shape doodles, as well as another self-portrait and two rectangles with the words "Making America Competitive Again." The online auction house had expected the item to be sold for $8,000. The sketches are accompanied by a letter from Samuel Sutton, the personal valet to Obama, who retained several souvenirs from the White House. More here.

The House Voted to Give Barack Obama, Former Presidents a Pay Cut
On Monday, the House voted to give former President Barack Obama and all former presidents a pay cut. The Hill reports that the legislation would reduce presidential pensions by about $4,000 to $200,000 per year and cap the budget for each former president’s office and staff expenses to $500,000 annually. Funds available for presidential office expenses would be reduced for every dollar a former president earns over $400,000. Eventually, the staff and office budgets would be phased down to $350,000 in six years and $250,000 in 10 years. Former presidents and their families would still receive the same amount of security provided by the government as they do today. According to one legislator, benefits for former presidents cost taxpayers $2.84 million in fiscal year 2017. Members questioned the necessity of providing funds for former presidents who can make millions of dollars from book deals and speaking engagements. Obama vetoed similar legislation in 2016 out of concern it would have unintended consequences by forcing out presidential office staffers without a transition period and possibly affecting government operations for former presidents’ security. He wrote in a message to lawmakers that he would sign the bill into law if Congress “returns the bill having appropriately addressed these concerns.” However, lawmakers did not act before Obama left office in January. Labor Secretary Alex Acosta is set to testify today before the Committee on Education and the Workforce at 10A. Acosta will talk about the Labor Department’s policies and priorities in this administration, and Committee Dems have questions for him. “Despite low levels of unemployment, millions of workers are still struggling to make ends meet and get ahead in the workplace. Over the last 10 months, the Trump administration has laid the groundwork to undermine workers’ wages, retirement security, health, safety, and skill development,” said Committee Ranking Member Congressman Bobby Scott (D-VA). “It is important for Secretary Acosta to come before the committee, as part of their vital oversight role, and answer the pressing concerns many of the Members have about the Department’s recent actions.” You can watch the hearing here.
Dems to Intro New Articles of Impeachment Today

and Steve Cohen (D-TN) today at 9A plan to introduce new articles of impeachment, Cohen’s office announced last night. The Hill says that it’s unclear how many other Democrats will join their efforts, and neither office would say what grounds the articles will cite. Gutiérrez had previously said that they were working with constitutional lawyers and will “not leave you lacking for reason ... It is clear to us that he is unfit to be president of the United States of America.” Previously, Congressmen Al Green (D-TX) and Brad Sherman (D-CA) had each introduced articles of impeachment, with Green coming close to forcing a vote on the floor of the House before pulling back at the last minute. Dems Question Ryan On Eminent Domain to Seize Private Lands for Trump’s Border Wall

, Beto O’Rourke (D-TX)José Serrano (D-NY), Juan Vargas (D-CA), and Vicente González (D-TX) wrote to House Speaker Paul Ryan (R-WI) urging him to clarify his position on whether the federal government should be permitted to use eminent domain to obtain land for the construction of Donald Trump’s border wall. The letter points out that more than 70% of the land along the Southwest border doesn’t belong to the federal government, so construction of the wall will require the extensive use of eminent domain to confiscate property owned by U.S. citizens and tribes. Speaker Ryan has repeatedly spoken out against the use of eminent domain in the past, but has yet to publicly state whether this mechanism should be employed by the Trump administration. “We write to ask whether you support the use of eminent domain to secure land for the construction of President Trump’s expensive and unnecessary border wall,” they write. “If so, we request that you explain the obvious contradiction between such a stance and your previous positions on this issue ... The prospect of the Trump administration fighting families in court for their own land should alarm every American. We trust that your concern for private property rights extends to families living on our southwest border ...” See the full letter here.

Krishnamoorthi Gets an Indian American GOP Challenger
On Monday, Jitendra "JD" Diganvker announced a bid for the Republican nomination in Chicago’s 8th Congressional District race, aiming to unseat Congressman Raja Krishnamoorthi (D-IL). Diganvker said he's previously worked for and owned car rental businesses, but now owns a credit card processing company. "I'm an entrepreneur, not a politician," Diganvker said. "Who's going to represent the common voice?" Diganvker is an immigrant who said his family has experienced many highs and lows since coming to the U.S. He and his wife lost his two daughters in a house fire while living in Chicago in 1999, and he said that motivated him to become a community activist. He adds that his experience as an Uber driver has helped him understand the needs of everyday Americans. More here.
Former TX Mayor Launched Bid for Lamar Smith’s Seat
Former San Marcos, TX Mayor Susan Narvaiz announced that she is running for the seat of retiring Congressman Lamar Smith (R-TX). The self-employed human resources and business operations consultant served as Mayor of San Marcos for three terms. This isn’t her first rodeo. She unsuccessfully ran for Congress against Congressman Lloyd Doggett (D-TX) in 2014 and 2016. One little hiccup this time around: she doesn’t yet live in the district, but says she plans to move there well before the election. The Ohio native who moved to Texas as a child says, “Our country is at a crossroads and now more than ever, we need strong leaders who are not afraid to fight for conservative values.” More here.

Time Bets on Latino Market and Intros Time Inc. Latino
Time Inc. revealed it’s putting an aggressive focus on the Latino market with the introduction of Time Inc. Latino. The new division looks to serve more English and Spanish language content tailored to the Latino audience. Time Inc. has a larger Hispanic/Latino audience than Univisión and Telemundo combined in digital, with a reach of 18.3 million, according to 2017 comScore Multiplatform/GfK MRI Media + Fusion data. For now, the new division is rolling out with two branded verticals -- People Chica and Planeta Futbol. The former will be an English-language extension of the People brand, and the latter is a Spanish-language collaboration between Sports Illustrated and 90min, a company that produces soccer coverage from around the world. But more is coming in 2018, according to People en Español’s VP and Brand Sales Director, Monique Manso (pictured), who is spearheading the project. She didn’t reveal what other new brands or verticals are on the horizon, but she did suggest that food and health and wellness are extreme areas of interest for the company. More here.

TV One’s Roland Martin and CNN’s Jake Tapper have beef and the battle has spilled over on Twitter. Last week, Martin took to Twitter to tell Tapper that the media needs to stop using the term “false claims” and instead should be using the word “lie” when calling out Donald Trump. Martin had taken issue with Tapper telling Treasury Secretary Steve Mnuchin that Trump had falsely claimed that the latest GOP tax plan was the biggest tax cut in history. Tapper replied he didn’t need to be lectured by Martin on journalism and that Martin still needed to answer for how his debate questions made it to Hillary Clinton’s campaign last year. And then shots were fired. In a series of tweets, Martin said, “Really Jake? Lecturing you? No one is lecturing you. I’m pointing it the fact that a lie is a lie. Second, I’ve addressed the issue. On @tvonetv. Now if you want to have a discussion about how @CNN disrespected us BEFORE the town hall. You tell me, Jake, why @CNN told @tvonetv PR folks to remove from OUR press release the plan to address Black issues? We ignored the request.” A few more tweets followed but that’s the gist. Tapper shot back in a series of tweets saying, “Here’s @rolandsmartin refusing to explain how his town hall questions went from @tvonetv’s possession to the Clinton campaign. Zero accountability, zero transparency, zero explanation, zero contrition ... And please stop trying to turn this into something other than me calling you out for lack of ethics and transparency.” See the full exchange here.

After being with CNN for nearly two and a half years, correspondent Tanzina Vega is leaving the network, she announced on Twitter. Originally hired as a Digital Correspondent covering tech and politics, Vega eventually transitioned to CNNMoney, where she covered race and inequality in America. During that time she has been listed as one of the 40 top Latinos in America media by The Huffington Post. The former NYT reporter said she is leaving to pursue “new opportunities.” More here.

Obama Alumnus Joins Tech and Healthcare Venture Capital Firm
Dhanurjay “DJ” Patil, the Chief Data Scientist under President Barack Obama, has joined Venrock Capital as an Advisor. During the Obama administration, Patil helped launch the White House’s Police Data Initiative, Data-Driven Justice, and co-led the Precision Medicine Initiative. Prior to the WH, he led the product team at RelateIQ prior to its acquisition by Salesforce and served as LinkedIn’s Chief Scientist and Chief Security Officer from 2008 – 2011. The University of California, San Diego graduate also holds a Ph.D. from the University of Maryland in applied mathematics. “My primary focus is building new models to improve healthcare and Venrock is the best out there,” Patil told TechCrunch. “I’ll be helping as they think through how security, data science/ML/AI, etc combine to make new models for improve health outcomes.” More here.
Smithsonian Anthology of Hip-Hop and Rap Exceed Fundraising Goal
A few weeks ago, we told you about a $250,000 crowdfunding campaign to raise money for the "Smithsonian Anthology of Hip-Hop and Rap," which will celebrate hip-hop, a distinctly African American music and art form that began in the 1970s in the Bronx, NY. Well the campaign, which ends today, exceeded its own expectations, raising more than $300,000. Music legends MC Lyte, Chuck D, and Questlove of The Roots are among celebrities who teamed with the Smithsonian on the project. The compilation will include nine CDs, more than 120 tracks and a 300-page book with extensive liner notes and essays by various artists, produced and released by Smithsonian Folkways Recordings. The project will also feature never-before-published photos culled from the Smithsonian’s National Museum of African American History and Culture's vast collection. More here.
Ex-Tesla Employee Files Racial Discrimination Suit
A former Tesla employee filed a lawsuit against the company that alleges the Fremont, CA facility operates under “pre-civil rights era race discrimination.” Marcus Vaughn says he and other Black employees experienced daily racial harassment from several co-workers. Among the allegations are that Black employees were “routinely” called “n—ger” and “n—ga” by other employees and that the company did nothing to stop it even after Vaughn reported the harassment to the human resources department. He says was fired last month for “not having a positive attitude.” The company has been accused of using poor performance reviews to dismiss workers who were trying to organize on behalf of the United Auto Workers Union. Former employee Jorge Ferro claimed he was mocked for wearing “gay tight” clothing and then harassed after complaining to the company. Tesla subsequently dismissed him, he claimed, alleging Ferro had been injured and, he said, telling him that there is “no place for handicapped people at Tesla.” The suit also includes an email from CEO Elon Musk that reads, “Part of not being a huge jerk is considering how someone might feel who is part of a historically less represented group. ... In fairness, if someone is a jerk to you, but sincerely apologizes, it is important to be thick-skinned and accept that apology.” reads the email. More here.

Tri-Caucus Members Question AG Jeff Sessions
Yesterday’s House Judiciary Committee hearing was must-see TV. AG Jeff Sessions faced tough questioning from Tri-Caucus members who all appeared to have loudly cracked their knuckles before entering the room. Congressman Ted Lieu (D-CA) suggested that Sessions lied to lawmakers when he failed to disclose the meetings during his confirmation hearing after being asked about contacts between the Trump campaign and Moscow. “You did have communications with the Russians last year, isn’t that right?” Lieu pressed. “I had a meeting with the Russian ambassador," Sessions answered. “Yes.” The exchange grew heated when Lieu said, “That is exactly the opposite answer you gave under oath to the U.S. Senate. Either you’re lying to the U.S. Senate, or you’re lying to the U.S. House of Representatives.” Congresswoman Pramila Jayapal (D-WA) informed the AG that it was difficult to take his assurances under oath when he seems to change his testimony each time new evidence emerges. She then went on to give several examples of this. She then went on to read Donald Trump’s quote calling U.S. intelligence official political hacks and asked Sessions if he agreed. After stumbling through a response she pressed him for a yes or know to which he replied he values U.S. intelligence officials.
Congressman Luis Gutiérrez (D-IL) opened up his line of questioning with this: “Your side clearly wants an investigation of Hillary Clinton, and our side has been begging for months to hold hearings and start an investigation of the Trump administration and campaign’s improper ties to Mr. Putin and the Russian government ... I propose we simply go to the president and the former secretary of state and ask them both to resign ... Now I did Google organizations that Hillary Clinton leads, and it came out zero, so I’m not sure what you’re going to get her to resign from. He continued, “Last time I checked, she got 3 million more votes than Donald Trump, but she lost the election. So I don’t know, why don’t we move on and really look at the nation.” Gutiérrez then reminded Sessions what Trump said during the second presidential debate that if he wins, he would instruct his attorney general to get a special prosecutor to look into Hillary Clinton’s “situation.” The Congressman asked if Sessions would fulfill that campaign promise. “We will comply with the law with regard to special prosecutor appointments,” Sessions replied. The sole person of color on the GOP side, Congressman Raúl Labrador (R-IL) threw Sessions a softball asking the AG what more Congress could do to protect the First Amendment with respect to religious liberty. He also followed up with questions about civil asset forfeiture.
Ranking Member John Conyers (D-MI) opened up his line of questioning with a series of yes/no questions about basic democratic norms that Sessions refused to answer clearly. Congressional Black Caucus Chair Cedric Richmond (D-LA) began with a reminder to Sessions that he testified against the former Senator's nomination. Then he went on to question him about Trump’s judicial nominees comprised of mostly white men. Then Richmond went on to question diversity in Sessions’ staff. The AG acknowledged that he has not a single Black senior staff member and there are hardly any Black nominees for judgeships or US attorney positions. "I do not have a senior staff member at this time that's an African American," Sessions said, adding that he recommended African Americans for positions in his time serving Alabama. Richmond also contrasted the treatment of people impacted by the opioid crisis with the way people were treated during the crack epidemic. Congresswoman Karen Bass (D-CA) took Sessions to task over the Black Identity Extremist report produced by the FBI. “Can you tell me what it means to you? Do you believe there is a movement of African Americans that identify themselves as Black identity extremists and what does that movement do?,” the Congresswoman asked. Sessions stumbled through a reply saying he knew there were groups with “an extraordinary commitment to the racial identity” that turned violent. “You aware of white organizations that do this as well?” Bass asked. “Given the movements such as the neo-Nazis, are they white?” The back and forth concluded when Bass’ time ran out.
Congresswoman Sheila Jackson Lee (D-TX) pressed Sessions on the controversy around Alabama Senate candidate Roy Moore. She asked if elected, did Sessions think his replacement should be seated in the Senate. Sessions said the department’s ethics officials advised him not to get involved with the Moore campaign, though Jackson Lee continued to press him on whether he would ever put Moore’s current controversy up for federal review. “We will do our duty,” Sessions responded. Congressman Hakeem Jeffries (D-NY) noted that Sessions had set a tough standard on false statements in the past -- voting to remove then-President Clinton from office after he was impeached on charges of perjury in the 1990s. The congressman also reminded Sessions that he had suggested to Fox News anchor Lou Dobbs that Hillary Clinton was guilty of perjury when in a conversation with the FBI about her email server, she said that she did not recall the answers to some questions. Congressman Hank Johnson (D-GA) asked simply why the AG recused himself from the investigation of the Russian interference in the 2016 elections to which Sessions replied, “Code of federal regulations said if you participate in a substantial role in a campaign, Department of Justice employee should not participate in investigating that campaign.” He also asked about the firing of FBI Director James Comey and the AT&T proposed acquisition of Time Warner which has come under scrutiny given Donald Trump’s public animus towards CNN.

Lawmaker Wants Answers from NIH on Funding for Gun Violence Research
Congressman Bobby Rush (D-IL) has a pressing question for the National Institutes of Health: did the NIH discontinue funding on gun violence research? Amid reports that the NIH has stopped funding research on this issue, Rush co-wrote a letter to NIH Director Dr. Francis Collins. “Gun violence is an urgent public health crisis facing communities across the country,” reads the letter, also authored by Congressman Frank Pallone Jr. (D-NJ). “It continues to present a hazard for public health and safety and resulted in the deaths of nearly 34,000 Americans in 2015.” The lawmakers want the NIH to explain why the program was discontinued if indeed the reports are true, and how many gun violence research grants were awarded from this funding. The importance of NIH funding on this issue was discussed last month at a forum exploring public health solutions to the gun violence crisis co-hosted by Rush and Pallone. Since 2013, NIH has dedicated $18 million to gun violence research. Gun violence disproportionately affects minority communities. African Americans account for over 50%  of the victims of gun homicide, and gun violence is the second-leading cause of death for Hispanic males between ages 15 and 34. See a copy of the letter here.

On Tuesday, Senators Bob Menéndez (D-NJ), Jeanne Shaheen (D-NH), Susan Collins (R-ME), and Johnny Isakson (R-GA) re-introduced the International Violence Against Women Act (IVAWA), bipartisan legislation that would ensure combating gender-based violence around the world is a top diplomatic and development priority for the U.S. “Every day, both at home and around the world, we see the news of women suffering from violence and denied the basic security and equal rights they deserve to live a prosperous life,” said Menéndez. “From genital mutilation in Somalia, to arranged child marriages in Afghanistan and Chad, to Rohingya women facing horrific mass rape, murder and arson – the fact is women and girls globally continue to face disproportionately high levels of violence. Vargas Crosses Aisle for Vets

reached across the aisle to join Congressman Bruce Poliquin (R-ME) and together they introduced the Wounded Warrior Housing Reform Act of 2017, a bill that they say will improve veterans’ access to housing assistance programs. Many veterans depend on federal benefit programs and disability payments every month to meet their needs. However, HUD -- which provides housing to vets -- considers a handful of these programs a part of a veteran’s income, and that reduces the housing assistance available for low-income disabled veterans. This bill would exclude those programs from being considered as income. “Our country’s veterans shouldn’t be facing obstacles that make it difficult for them to receive the benefits they’ve rightfully earned,” said Vargas. Congressmen Salud Carbajal (D-CA) and Lloyd Smucker (R-PA) have introduced similar legislation. Congressional Hispanic Caucus Chair Congresswoman Michelle Luján Grisham (D-NM) opens up to Forbes Magazine about caring for her mother. “I have to be on it every single minute of every single day, and I need help,” she said at a Capitol Hill briefing last week. Grisham co-founded and co-chairs the bipartisan Assisting Caregivers Today (ACT) Caucus. But even she finds it difficult to navigate caregiving for her mother, who has physical limitations and, increasingly, cognitive impairment. Although she lives five days a week in an assisted living facility and has paid caregivers at home the two other days for when Grisham is not with her, the Congresswoman said she still must follow up on everything: Was her mother's linen changed when it was supposed to be?
