TTB Reminder on Use of Social Media Advertising for Alcohol
The Alcohol and Tobacco Tax and Trade Bureau (TTB) recently published a new industry circular regarding the use of social media in the advertising of alcohol beverages. In it, TTB reminds industry members of mandatory information, certain exceptions and prohibited practices in alcohol beverage advertising. The bureau also provides its views and guidance on several areas including websites, social media networks and influencers, media sharing sites (e.g., YouTube, Instagram, etc.), blogs, microblogs (e.g., Twitter), crowdsourcing and crowdfunding sites, mobile apps, links, QR codes and augmented reality. Specifically, TTB reminds industry members of the prohibited practices in 27 C.F.R. § 4.64, which includes prohibitions on misleading health-related statements. The bureau makes clear that those regulations apply to all advertisements including in social media posts and with content created by another party (e.g., a scientific study) that is reposted or “liked” by an industry member.
