Common Hazardous Waste Violations |
This article concludes our overview of the TDEC Waste Management Branch (WMB)*. In previous issues, we outlined the branch’s regulatory role and what facilities can expect during an inspection. To complete the series, this final installment highlights the most common violations found at facilities that generate and manage small quantities of hazardous waste (SQGs).
The rules that apply to each violation are listed under each heading. It’s good practice to keep the rules with your environmental information so you can reference them easily.
The rules are different for very small quantity generators of hazardous waste (VSQGs). VSQGs must ensure delivery of hazardous waste and conduct hazardous waste determinations. To read the rules about VSQGs, go to Rule 0400-12-01 (the same as SQGs).
*Note that the Division of Solid Waste Management has combined with the Division of Remediation to create the Division of Land Protection. In the Division of Land Protection, the waste regulatory group is now referred to as the Waste Management Branch.

Make sure containers are labeled as “Hazardous Waste" and indicate the hazard that the waste presents. This can be done multiple ways: list the characteristic, pictogram, DOT placard, or NFPA label.
- If the waste is classified as universal waste, make sure to label the container as "Universal Waste" and what the waste stream is, for example, "Universal Waste - aerosol cans."

Failure to Notify Within 30 Days of a Change |

- Notify WMB within 30 days of a change. This includes changes in ownership, location, waste stream, and contact information. To notify, see the forms on the Hazardous Waste Notification Forms page.

Any containers with hazardous waste must be closed. The only time they should be open is adding or removing waste.

Failure to Conduct Weekly Inspections |

- The accumulation area must be inspected once a week.
- Make sure someone can check the accumulation area every week, even during holidays.

Exceeding Accumulation Weight and Time |

Document how long the waste has been accumulating.
- There are weight and time limits on how much and for how long a very small or small quantity generator can accumulate hazardous waste.

Failure to Make Hazardous Waste Determinations |

- Document hazardous waste streams and keep the determination and a flow diagram of the facility's hazardous waste on site.

- Ensure
- you have a permitted transporter and destination,
- waste is identified with waste codes and review the manifest,

confirm receipt with the destination facility and make sure it's signed,
- and any land disposal restrictions go with the manifest.

TDEC Division of Land Protection: Survey for New Waste Tire Hauler Program Training |
The Division of Land Protection's Waste Management Branch is gathering input on training preferences for the new Waste Tire Hauler Program. The Division asks interested groups to complete a brief survey by the end of July indicating whether they prefer in‑person or virtual training. This information will help staff plan and coordinate future training sessions.
