Legal Forms Spotlight Series: The Listing Contract |
IAR’s legal forms library is one of our most valuable member resources – helping client relationships and transactions move seamlessly and consistently through closing while reducing broker liability. But with more than 140 forms subject to regular updates and revisions, it’s helpful to have a refresher on some of the commonly-used forms, contractual terms and provisions.
The Legal Department has launched a video series to do just that, starting with the Listing Contract as we head into the heaviest months of new homes hitting the market. In this inaugural video, IAR Senior Staff Counsel Kelly Shonborn focuses on the fact-gathering function of the listing agreement:

Affordability improves in February, but buyers with budgets below $250,000 still holding back: |
- Closed home sales and new pending sales increased sharply from January to February with mortgage rates averaging just over 6%: February closings (4,881) were up 17% month-over-month, while pending contracts (6,065) increased 10%.
- Closed sales still finished 1% behind February 2025, while new pending sales outpaced last year by 1%.
- Homes sold for a statewide median of $260,000, up 4% from January and also compared to February 2025; this represented 94.5% of the original list price, consistent with 2025.
- The price per square foot for existing homes also rose 3.5% from February 2025 to 2026, from $149 to $154.

Sellers remained active in February with 6,583 new listings (also up 4% year-over-year); overall supply was 13% higher than last year with 14,571 listings available on an average day through the month.
- Properties are on the market for 31 days from listing to pending sale, a week longer than 2025 as higher inventory allows buyers to take a more deliberate pace.

Lower rates have cut potential mortgage payments – the median monthly payment for a recent home purchase has now fallen for seven straight months and is down 2% year-over-year despite a higher median sale price.

Even though affordability has improved, first-time buyers have been slow to re-enter the market according to sales totals to date: January and February pending sales below $250,000 are down 7% versus last year while pending contracts above $350,000 are up 10% year-to-date.

Please consider applying for an NAR assignment that matches your interests and expertise; the application process has changed, so please look over these highlights from NAR. (And note that if you already are involved or have completed an Expertise Profile, you will need to submit updated information for the new system – see below!)

The new Expertise Profile will help members provide the most relevant details about their experience, ensuring the information they submit supports accurate matching to the committee roles best aligned with their strengths.
- Space for clearer descriptions of expertise and professional designations.

Expertise Profiles are required for applicants, and all members will be required to complete a fresh profile if seeking an appointment in 2027.
- Moving forward applicants will be asked to review and update their Expertise Profile annually. (Note: Existing Expertise Profiles cannot be used moving forward and are no longer editable.)

Specialized Application Experience: |

Applications will be tailored to the area of committee focus, ensuring candidates are matched with positions based on relevant qualifications.
- The new process introduces a Vice Chair application, with new questions to better highlight leadership experience and committee-specific expertise.

Improved Endorsement Process: |

Endorsements will focus more on professional experience rather than personal relationships.
- Endorsers will see each committee's purpose and qualifications to help them provide more informed recommendations.

The annual REALTORS® Legislative Meetings in Washington DC connect IAR members with Indiana’s congressional delegation to make your voice heard on behalf of Hoosier homeowners and the real estate industry.
