Agency Rulemaking Highlights
Notable ActionsCommunity Reinvestment Act The Comptroller of the Currency, Federal Reserve Board, and Federal Deposit Insurance Corporation issued a final rule to amend the implementation of the Community Reinvestment Act of 1977 (CRA) to update how CRA activities qualify for consideration, where those activities are considered, and how those activities are evaluated. The rule creates a framework to assess a bank's performance through CRA regulations based on the bank's asset sizes and types. Effective April 1.
Emergency Response Standard The Occupational Safety and Health Administration issued a notice of proposed rulemaking to replace the existing Fire Brigades Standard. The proposal would include a wider range of emergency responders and aim to protect them from several occupational hazards. Comments due May 6.
Standard Flood Insurance Policy The Federal Emergency Management Agency issued a notice of proposed rulemaking that would add a new Homeowner Flood Form and five accompanying endorsements. The new form would replace the Dwelling Form as a source of coverage for homeowners of one-to-four family residences, increasing options and coverage for homeowners. Comments due April 8.
H-1B Registration Selection Process The Department of Homeland Security issued a final rule to implement a beneficiary centric selection process for H-1B visas that would allow each unique beneficiary to be entered into the selection process once regardless of the number of registrations submitted on their behalf. The rule also includes start date flexibility for some petitions and adds additional integrity measures for registration. Effective March 4.
Medications for the Treatment of Opioid Use Disorder The Substance Abuse and Mental Health Services Administration issued a final rule that would expand access to care and treatments for opioid use disorder and update regulations related to the Opioid Treatment Program, including making flexibilities put forth during the COVID-19 pandemic permanent. The rule also removes DATA-2000 Waiver requirements. Effective April 2. See Bridget Dooling and Laura Stanley’s RSC work on opioid use disorder treatment.
Medical Devices; Quality System Regulation Amendments The Food and Drug Administration issued a final rule to amend the device current good manufacturing practice of the Quality System to better align with international consensus standards for quality management systems. Effective February 2, 2026.
Prevention and Elimination of Digital Discrimination The Federal Communications Commission issued a proposed rule that would require annual reports from broadband providers that outline the demographics of communities served and not served by recently completed substantial broadband projects. The Commission also seeks comment on establishment of an Office of Civil Rights. Comments due March 4.
