Haaland v. Brackeen, 599 U.S. 255 (2023) | Oral Argument Here
Haaland v. Brackeen is a landmark Supreme Court case decided in June 2023. The Supreme Court upheld the constitutionality of the Indian Child Welfare Act (ICWA). The ICWA is a forty-three-year-old federal law that protects the rights of Indian children and families impacted by the child welfare system. The Act helps keep Indian foster children connected to their community and culture by requiring state courts to place an Indian child with an Indian caretaker. Therefore, the Supreme Court’s ruling reaffirmed tribal sovereignty by recognizing the rights of tribal nations to be involved in child welfare matters.
