I-9 Compliance
Form I-9 is used for verifying the identity and employment authorization of individuals hired for employment in the United States.  New employees must complete and sign their I-9 no later than their first day of employment, and must provide supporting I-9 and work eligibility documents to HR within three business days of starting work.
If you have an employee who has started work and has NOT completed their new hire paperwork, including their I-9, they must cease work immediately until this has been done.
Violations to this law may result in:
  • Civil Fines (up to $1,100 per person)
  • Debarment from government contracts

Changes to Academic Professional Hiring 
The new AAUP collective bargaining agreement includes some process changes to the recruitment and hiring of Academic Professionals.  
  • A job posting must be opened internally to current PSU Academic Professionals for 10 business days.  If  an employee who meets the minimum qualifications of the position, they are guaranteed a first round interview.  Please read Article 17, Section 11 for more details.
  • Academic Professionals hired after July 1, 2016 will serve a trial service of six months. Article 17, Section 5 explains this further. 
Academic Wage Agreements

It is critically important that the approximate number of work hours per week/month listed on a salaried wage agreement accurately represent the actual number of hours that will be worked.  These work hour projections are carried forward in "job" set up as the number of work hours when we pay the employee, thereby driving the following work hour based compliance programs:
1)  Sick leave accrual under PSU policy and Oregon law
2)  Compliance and eligibility tracking under the Federal Affordable Care Act
3)  Initial and annual retirement program eligibility under Oregon statute, and monthly work hour reporting to PERS

Salary wage agreements will largely become a thing of the past under new Federal overtime regulations.  PSU must be fully compliant with these new regulations by December 1st.  The new regulations specify that all non-instructional employees paid less than $913 per week are eligible for overtime (hourly).  To ensure compliance by December 1st, effective immediately, wage agreements offering less than $913 per week should be offered as hourly.  Wage agreements for non-credit instruction, and for an employee to perform "overtime exempt duties" at a rate higher than $913 per week, will be allowed as salaried.

Update on Overtime Law Changes
On May 18, 2016, the U.S. Department of Labor (DOL) released new overtime rules under the Fair Labor Standards Act (FLSA) increasing the salary threshold for "white-collar" overtime exemptions for the first time since 2004.  Effective December 1, 2016 non-instructional employees, including those in positions with job duties that have been determined to be exempt from overtime, with a salary of less than $913 per week (equiv. to $47,476 12-month annual) will become subject to overtime.  As such, they will be required to complete monthly time reports (time sheets) documenting their actual time worked.
In order to review and designate positions as overtime exempt based on executive, professional or administrative duties (the white-collar exemptions), HR requires a review and update of all non-instructional unclassified position descriptions be completed in PeopleAdmin.  HR will begin contacting individual departments that have yet to update their position descriptions.
Online Leave Reporting Coming Soon!

HR has been slowly rolling out PSU’s new Online Leave System, replacing paper leave rosters for faculty and overtime ineligible staff employees, for reporting monthly leave use.  Accessed through Banweb, this new tool allows employees to request leave and to submit their monthly leave report for online approval.  
Our goal is to have all of campus using the new system fall term.  On October 1, 2016 we will switch all remaining departments to the Online Leave System in time for reporting September leave use.  If you are not already on the leave system, expect to see an email at the end of September welcoming you to the new system.  On October 1st you will begin receiving email from the system letting you know the system is available for you to report your leave activity.
The system has been receiving rave reviews and one of the consistent comments is that it is easy and intuitive to use. However, if you would like assistance navigating the Online Leave System, we will hold several open houses in early October where you can get help entering or approving leave.

HR Urban Legend
It is fine to allow an employee to combine her breaks and meal period at the end of the day so she can leave early.
False! Employment law is paternalistic.  Often, even if the employee wants something (combining lunch and break) the rules don’t allow it.  Here, the idea is that breaks and a meal period are necessary for the health of workers and must therefore be spaced out appropriately.  Oregon law regulates when breaks must be taken.  The Rest and Meal Period chart below can be located on our Payroll website
