Previous flexibilities for mealtime requirements in SFSP have been modified and codified in the Code of Regulations per the September 2022 Final Rule.
Per the recent September 2022 Final Rule, flexibilities for utilizing an Offer Versus Serve (OVS) method of service in SFSP have been modified and codified in the Code of Regulations.
Prior to Summer 2023, regulations stipulated that CEs visit each site within the first week of operation unless waived by TDA. Per Final Rule, Streamlining Program Requirements and Improving Integrity in the Summer Food Service Program (SFSP), published September 19, 2022, and going into effect Summer 2023, the site visit requirements have changed.
The "traditional" waiver that allowed closed enrolled SFSP sites to become eligible based on being located in a low-income area has been codified in the Code of Federal Regulations per the September 2022 Final Rule. However, CEs wishing to operate a closed enrolled site must provide justification for why they are not able to service the community.
Per the recent September 2022 Final Rule, new CEs in good standing in NSLP, SBP, and/or CACFP may be exempt from the lengthier SFSP application process that most new CEs must follow if they meet certain criteria.
The Final Rule, Streamlining Program Requirements and Improving Integrity in the Summer Food Service Program (SFSP), published September 19, 2022, codified in the Code of Federal Regulations (7 CFR 225) specific Performance Standards that SFSP CEs must adhere to in order to operate SFSP.
