PA Superior Court Confirms Requirement for Seller Disclosure

A recent decision by the Superior Court answered questions about seller disclosure requirements in a case involving an apparent mixed-use property being sold ‘as is’. The case involved a residential property that also served as the site of owner’s business. The owner of the property was mistakenly led to believe that because the property was used for a commercial use and that it was being sold ‘as-as’, a seller property disclosure form was unnecessary.

In an article published in PAR JustListed, PAR Counsel Jim Goldsmith reviews the case including the court’s  conclusion that the Seller Disclosure law requires the seller to provide a seller disclosure for all residential dwellings regardless of any agreement between the parties (such as the agreement to convey the property ‘as-is).

Middletown Township Sewer Authority to Require Sanitary Sewer Certificate

Effective Sept. 1st, the Middletown Township Sewer Authority (MTSA) will implement a new sanitary sewer certification program that requires the inspection and certification of building sewers and the payment of all sewer rentals and tapping fees prior to the sale, transfer or refinance of any property by a property owner. This program expands existing remedial efforts to reduce treatment costs caused by inflow and infiltration (I&I), which are unwanted sources of storm water that enter the sewer system.
Prior to the transfer or refinance of any property in Middletown Township, an inspection of the building sewer must be completed, and a Sanitary Sewer Certificate must be issued by MTSA. The inspection and certification require a minimum of two weeks to complete. The complete list of requirements of the sewer certification program may be found on MTSA’s website. All lateral inspection applications received before Sept. 1st. with a settlement closing date before Oct. 1st will not require a camera inspection.
