Kennedy v. Bremerton School District: The Court’s New Religion Clause Jurisprudence
In
Kennedy v. Bremerton School District (2022), the Supreme Court ruled that a public high school violated the Free Exercise Clause by disciplining a football coach for praying on the field after games. The ruling suggests that the Court has adopted a new approach to the Religion Clauses that looks to history and tradition, rather than non-endorsement, as the proper constitutional test.
Professors Stephanie Barclay (University of Notre Dame), Marc DeGirolami (Catholic University of America), and Mark Movsesian (St. John’s) will lead a panel discussion about Kennedy and its implications for the Court’s Religion Clause jurisprudence.
