New Minnesota Housing Lead-Based Paint Guide  
A new version of the Minnesota Housing Lead-Based Paint Guide (Guide) has been released and will replace the existing Guide. The Guide applies to all rehabilitation projects funded through the Community Homeownership Impact Fund, the Emergency & Accessibility Loan Program (ELP), the Rehabilitation Loan Program (RLP), and the Workforce and Affordable Homeownership Development Program. It is effective for all rehabilitation projects started on or after June 1, 2020.

Changes include the following:
  • Removing the lead abatement requirement
  • Allowing for flexibility for Safe Work Practices to follow the Environmental Protection Agency’s (EPA) Renovation, Repair and Painting Program
  • Allowing for utilizing either the EPA or the Department of Housing and Urban Development (HUD) definitions of De Minimis levels of painted surfaces. 
The new  Guide also provides information and the minimum requirements under Minnesota Housing’s Lead-Based Paint Policy for the following areas:
  • Clearance 
  • Disclosures
  • Risk assessments
  • Interim controls
  • Safe work practices 
Please make sure to use the new version of the Guide when completing rehabilitation projects funded by the programs noted above. The updated document can be found here for the RLP and ELP programs, and here for Impact Fund and Workforce and Affordable Homeownership Development programs.
