COVER STORY
TMA's vigilance thwarts Medicare gaffes...
The missteps also come as Congress considers a major overhaul to a program that continues to frustrate physicians and threaten access to care. Earlier this year, Medicare printed incorrect patient responsibility amounts for claims submitted by non-participating physicians. Meanwhile, despite medicine's warnings against it, Medicare proceeded with audits of the Physician Quality Reporting System. Only the "survey" letters physicians received shrouded the fact that they were, in fact, audits, at the same time threatening recoupment for nonparticipation even though they are voluntary. TMA alerted Medicare and the AMA of the issue, and it seems the collaboration is leading to a fix to clarify the language in the audit requests.

PUBLIC HEALTH
About 2,000 patients younger than 25 die each year of sudden cardiac arrest in this country. The Texas House passed House Bill 767, which requires students to receive an electrocardiogram (EKG) before they can play high school sports.  The article will include insight on the topic from TMA member physicians who care for student athletes and will include information on TMA members' review of the available scientific evidence and the basis for the association's recommendation to the legislature.
LAW
The Texas Medical Board (TMB) recently adopted a rule that attempts to clarify the minimum standards for maintaining an adequate medical record, when communication with physicians outside the office setting (such as texts and emails) regarding a patient should be reflected in the medical record, and that prepopulated fields in electronic health records (EHRs) implying tests were performed must contain accurate data.  TMA often receives questions about medical records from member physicians, so it's important we update them on the new rule. The article will cite some stats from TMB on enforcement actions related to medical records violations to illustrate how important it is to follow the rules
