Export Controls
The U.S. Department of Commerce, Bureau of Industry and Security (BIS) implemented a new Affiliates Rule, effective September 30, 2025, significantly expanding the scope of export controls under the Export Administration Regulations (EAR). The rule extends existing restrictions under the BIS Entity List, Military End User (MEU) List, and other end-user controls which expands the ‘entity list to cover affiliates of listed entities’. This measure aims to prevent circumvention and diversion through “affiliates” and mirrors the Office of Foreign Assets Control’s (OFAC’s) 50% Rule, and will require universities  to enhance due diligence measures, add new Red Flag screening, and ensure ownership verification.
