Legislative Update: Fines, SMM, and Silica

The CDRA’s Legislative Committee has been actively monitoring or working on issues that affect the C&D recycling industry. Our work has an impact on every business in the sector, and we urge you to provide us input on any of these issues, as well as alert the committee to needed work on other issues.
  • OSHA’s employee silica exposure rule is now in effect, although we have not heard of any CDRA members being inspected for how silica exposure they subject their employees to. Your association has submitted questions on the rule for clarification to OSHA, and we will share those answers when we get them. This rule affects concrete recyclers, and for its members CDRA prepared information on how to comply with the new rule. Please contact CDRA headquarters at info@cdrecycling.org if you need that information.

  • The U.S. Environmental Protection Agency’s Sustainable Materials Management in the Built Environment project will be proceeding with a meeting of invitation-only stakeholders Jan. 30 to Feb. 1 in Washington, DC. The CDRA has been a major driver of this conference, as we want the focus to be more on end of life issues in green building and sustainable materials management. Another issue is “green” building materials now used that will have no end-of-life options outside of the landfill. We contend any product that does not have a chance to be recycled or reused should not be considered green.

  • Dr. Tim Townsend’s work on C&D fines continues at the University of Florida. He and his team are now visiting selected C&D recycling facilities across the United States to do more in-depth analysis.

  • Another project Townsend’s team is working is an update of C&D regulations of all 50 states. The project was first completed four years ago, and as we all know there are changes in those rules on a regular basis. For example, New York’s Department of Environmental Conservation did a major overhaul of its waste regulations that was announced earlier this year, and those rules seriously affected C&D in the state. In addition to a regulation update, we will be adding information on what each state considers C&D biomass, and, it stance on C&D fines.

  • A material some find challenging to recycle is gypsum. A few years ago, the European Union developed a protocol on the recycling of gypsum. While that document will not work perfectly in North America, the CDRA has tasked Dr. Townsend into revising the protocol into something we can promote over here. Note that gypsum, besides being difficult to recycle, also contaminates C&D loads, making them more challenging to recycle, or in the case of C&D fines, even to dispose of because of the odors that can be created in landfills.

Many people may not know that C&D World started before the formation of the CDRA. 2018 International Biomass Conference & Expo
