House Enrolled Act 1347 Becomes Indiana Law on July 1st |
Trust account requirements, annual CE audits and managing broker eligibility changes coming soon |
This week marks the beginning of the state fiscal year: New Indiana laws take effect on July 1st, a new two-year state budget begins, and the next Continuing Education cycle starts (remember, you have until midnight on Monday to complete required CE for this year!).
Among the changes to state law passed by the Indiana General Assembly this year are several real estate industry priorities covered by House Enrolled Act 1347. HEA1347 impacts real estate business practices, licensing and agency representation – the changes are positive for REALTORS® and consumers, but it’s important to take note of what’s new.

A brief summary of what HEA1347 does (and what REALTORS should know) effective July 1st:

Closes a loophole in state law by clarifying that brokerages must maintain trust accounts to manage earnest money and other client funds.
- Increases the eligibility requirement to become a managing broker from two to three years as an active (licensed) broker as well as passing a written test developed and administered through the Indiana Real Estate Commission.

Requires the Real Estate Commission and the Professional Licensing Agency to conduct annual audits of Continuing Education, checking a random sample of 1-10% of active and eligible licensees each year to ensure they have completed their required twelve hours of CE. (Remember, the 12-hour annual requirement doesn’t kick in until two years after licensing – this doesn’t change under the new law.)

Expands Indiana’s requirement for written buyer and listing agreements - adding “tenant” to buyer and “authority to lease” to authority to sell, so written agency agreements are required to represent lessees and landlords along with property buyers and sellers. (As Richelle mentions in the video, parties to a lease transaction are already included in IAR’s exclusive buyer agency and listing contracts, so our current legal forms will continue to reflect Indiana law after July 1st.)
- Finally, HEA1347 adds two new conditions that must be disclosed by the seller – if a property is located within a locally-designated historic district or a conservation easement. (The property owner still carries all responsibility and liability for disclosing known conditions or defects.)

Buyers, Sellers and the Market: Housing Hub Highlights |
As we hit the halfway mark of 2025, don’t forget to check the Indiana Housing Hub for the latest regional and local market data and original analysis that can help inform prospective buyers and sellers; below are a few research highlights from the past few months.

Over the last ten years, more than 45% of annual statewide listings are added to Indiana MLSs after June 30th: There are prospective summertime sellers out there who may still be holding back – and could be reassured by fresh data on rising property values and equity growth across Indiana.
We tracked twenty years of repeat MLS sales to measure real price appreciation and found a positive trend dating back to 2013; homeowners have continued to build equity (though at a slower pace) since the peak of 2021-2022 – they didn’t “miss the market” by staying in their homes over the past three years.
We find that homeowners who bought in the 2-3 years before the pandemic are now selling in greater numbers as they hit six figure median equity levels – a point where the difference in current and potential mortgage rates isn’t so daunting if they’re motivated to move. Middle-Income Affordability |
Even with a dozen years of increasing home values, there’s also good news at the Hub on affordability in Indiana compared to the national housing market. Roughly 40% of Indiana home listings are affordable to households earning $75,000 (just above the state’s household median income of $70,000) - nearly double the national rate (21%). And middle-income homebuyers have more options across the state’s metro regions. Learn more and see how your local market stacks up here.
