This June, we celebrate Indigenous, queer, and gender-diverse creators and innovators who strive for a better tomorrow despite centuries of suppression. We recently featured news about an Annishinabe artist's work to engage with his heritage and a gay rapper's success in music and fashion. The IP Innovation Clinic seeks to empower underrepresented communities. We hope to continue to help innovators who make Canada's IP landscape as vibrant as Canada itself.

Nintendo v Bowser: Hacking and Piracy in Video Games

Like its predecessors, the 2017 Nintendo Switch is not immune to hacking and piracy. The modification of video game consoles typically enables the unauthorized use of illegally obtained game cartridge data (stored in ROMS) or fan-made ‘homebrew’ content. Some modifications allow pornographic content to be published within Nintendo games. Hacking and piracy in the video game industry has even sparked international concerns, with hacks appearing on open marketplaces such as Amazon.

Fedcoin?: Digital Currency and Privacy

The near ubiquity of Alipay in China and the Bank of Canada’s (BoC) announcement of a Central Bank Digital Loonie (CBDL) foreshadow a future of digital currency. The U.S. dollar is also a form of digital currency managed by the Federal Reserve Bank. As of December 2019, almost ninety percent of US dollars were purely digital. Only eight percent of the world’s currency exists as cash. The United States Congress has already begun to contemplate “Digital Dollar” proposals to protect the financial wellbeing of hardworking Americans.

What to do when Anything is Possible: A Brief Note on the Problems Surrounding the Regulation of Deepfakes

Thanks to deepfakes, it is becoming increasingly difficult to tell whether a video is real or not. Deepfakes are machine learning processes that synthesize video and audio recordings using the images and sounds belonging to individuals not present in the original recordings in order to produce realistic impersonations. As the technology behind deepfakes further develops, it becomes more accessible. What results is the widespread use of deepfakes for nefarious purposes, such as pornography (96 percent of its use according to a 2019 inquiry), and influencing elections. The rapid development of deepfakes also threatens to influence our understanding of the world.

Canada's IP Writing Challenge 2021: Founded by the Intellectual Property Institute of Canada (IPIC) & IP Osgoode

IPIC and IP Osgoode wish to enhance intellectual property public policy research and discussion among law students, graduate students, and legal and business professionals. Prizes include $1000 (CAD), publication on the IPilogue, and consideration for publication in the Canadian Intellectual Property Review and/or the Intellectual Property Journal.

IP Osgoode Presents Bracing for Impact: AI's Dirty Footprint

The third Bracing for Impact Webinar, titled “AI’s Dirty Footprint”, addresses the environmental implications of artificial intelligence (AI) developments in recent years. AI can be a double-edged sword, and while it can make resources and information more accessible, it also requires more energy to use and, as a result, increases our carbon footprint.
Panelists Audrey Lee (Microsoft), Neetika Sathe (Alectra), and Kapil Singhal (Vyntelligence) will look closely at this impact and discuss ways to foster sustainability. This webinar is organized by IP Osgoode in collaboration with the Harry Radzyner Law School at the IDC Herzliya in Israel, Microsoft Canada, and this time appropriately Alectra's GRE&T Centre.
This session will talk about best practices for copyright, trademark and patent settlements. Seasoned practitioners will explain advanced tips to ensure that a deal protects the interests of all parties. Register for this event here.

IP PICK OF THE WEEK

Is the UK’s flagship industrial policy a costly failure?
The University of Cambridge Centre for Business Research prepared this independent report analyzing the UK's 2013 Patent Box scheme, meant to increase IP commercialization. The report suggests that the government did not address the underlying need to promote new STEM-based companies to replace declining industries. Read the report here.
